As per Republic Act No. 6953, September 09 is declared a SPECIAL NON-WORKING DAY in the City of Cebu and the Province of Cebu, with its component Cities, in honor of the late President Sergio Osmeña, Sr.

In the entire Province of Cebu, if the Employee did not work, the "no work, no pay" principle shall apply, unless there is a favorable company policy, practice, or Collective Bargaining Agreement (CBA) granting payment on a Special Day.

For work done, the Employee shall be paid an additional 30% of his/her basic wage on the first eight hours of work.

It is considered a Special Working Public Holiday in the rest of the Country.

𝐅𝐘𝐈 │ 𝐀𝐏𝐏𝐋𝐈𝐂𝐀𝐓𝐈𝐎𝐍 𝐅𝐎𝐑 𝐄𝐗𝐄𝐌𝐏𝐓𝐈𝐎𝐍

As per NWPC Guidelines No. 03, S. 2020, Omnibus Rules on Wage Determination (Rule VII), the following Establishments may apply for exemption from the compliance with the present Wage Order:

𝟏. 𝐑𝐞𝐭𝐚𝐢𝐥 𝐨𝐫 𝐒𝐞𝐫𝐯𝐢𝐜𝐞 𝐄𝐬𝐭𝐚𝐛𝐥𝐢𝐬𝐡𝐦𝐞𝐧𝐭𝐬 𝐑𝐞𝐠𝐮𝐥𝐚𝐫𝐥𝐲 𝐄𝐦𝐩𝐥𝐨𝐲𝐢𝐧𝐠 𝐍𝐨𝐭 𝐌𝐨𝐫𝐞 𝐓𝐡𝐚𝐧 𝟏𝟎 𝐖𝐨𝐫𝐤𝐞𝐫𝐬
Requirements:
- Affidavit of Undertaking of the Employer stating the number of Employees and duration of their employment.
- The fact that it Notified its Workers of its Action to Apply for Exemption.
- The fact that it is Compliant with the Previous Wage Order.
- Certified True Copy of the Business Permit for the Current Year issued by the concerned Local Government Unit.
- In case the application is not granted, the Employees shall receive the appropriate increases due them plus interest of one percent (1%) per month retroactive to the effectivity of the Wage Order.

𝟐. 𝐄𝐬𝐭𝐚𝐛𝐥𝐢𝐬𝐡𝐦𝐞𝐧𝐭𝐬 𝐀𝐝𝐯𝐞𝐫𝐬𝐞𝐥𝐲 𝐀𝐟𝐟𝐞𝐜𝐭𝐞𝐝 𝐁𝐲 𝐍𝐚𝐭𝐮𝐫𝐚𝐥 𝐂𝐚𝐥𝐚𝐦𝐢𝐭𝐢𝐞𝐬 𝐚𝐧𝐝/𝐨𝐫 𝐇𝐮𝐦𝐚𝐧-𝐈𝐧𝐝𝐮𝐜𝐞𝐝 𝐃𝐢𝐬𝐚𝐬𝐭𝐞𝐫𝐬 𝐎𝐫 𝐁𝐲 𝐭𝐡𝐞 𝐏𝐚𝐧𝐝𝐞𝐦𝐢𝐜 (𝐍𝐖𝐏𝐂 𝐆𝐮𝐢𝐝𝐞𝐥𝐢𝐧𝐞𝐬 𝐍𝐨. 𝟎𝟏, 𝐒𝐞𝐫𝐢𝐞𝐬 𝐨𝐟 𝟐𝟎𝟐𝟐)
Requirements:
- Affidavit of Undertaking of the Owner, General Manager or Chief Executive Officer stating the following:
a) Amount of loss/ damages suffered.
b) List of properties damaged / lost together with its estimated valuation.
c) The fact that it notified its workers of its action to apply for exemption from payment of wage increases.
d) The fact that it is compliant with the previous Wage Order. Pictures of damaged business property, if applicable.
e) In case of a pandemic, the Audited Financial Statements for the last 2 years stamped received by BIR. IN extreme cases, the Interim AFS may be required in lieu of the last 2 years.

In case the application is not granted, the Employees shall receive the appropriate increases due them plus interest of one percent (1%) per month retroactive to the effectivity of the Wage Order.

If exemption is granted, the Establishment shall be fully exempted for a period of one (1) year from effectivity of the Wage Order.

Last day of filing of Application for Exemption is on 𝟏𝟐 𝐀𝐔𝐆𝐔𝐒𝐓 𝟐𝟎𝟐𝟐.
