"Attorney, usa ko ka maestra nga buntis apan dili ko kasado sa amahan sa akong gisabak, ma suspenso ba ko sa skwelahan kung asa ko nagtudlo?"
NO. AN UNMARRIED SCHOOL TEACHER WHO GETS PREGNANT CANNOT BE SUSPENDED FROM HER EMPLOYMENT.
The Supreme Court in the case of Bohol Wisdom School v. Mabao [G.R. No. 252124, 23 July 2024] ruled that premarital sexual relations resulting in pregnancy out of wedlock cannot be considered disgraceful or immoral when viewed against the prevailing norms of conduct.
So long as there is no legal impediment between the school teacher and her sexual partner to marry each other and that the sexual relations between them are consensual, the fact of pregnancy cannot be considered immoral as it does not contravene any fundamental state policy.
