Persons deprived of liberty retain their constitutional right to confer privately with counsel. A counsel visit enables the lawyer and client to discuss the case, review developments, and prepare for the proceedings within the bounds of law and professional responsibility.

Legal representation continues beyond the courtroom. Sometimes, it requires meeting the client where access to counsel matters most.

The Rules of Court exist for a reason: to promote the orderly, fair, and efficient conduct of judicial proceedings. They provide the framework through which the rights of the parties are protected and cases are resolved in accordance with due process.

At the same time, faithful observance of procedural rules must be accompanied by diligent attention to the lawful interests and welfare of the client. It has been a busy and productive period at the office, with activities involving legal consultations, new engagements, retainership matters, drafting and reviewing documents, and notarization of various instruments. From discussing legal concerns to preparing and completing the necessary documents, much of the work continues quietly within the office and outside the courtroom.

𝐀𝐩𝐩𝐞𝐚𝐫𝐞𝐝 𝐚𝐭 𝐭𝐡𝐞 𝐂𝐞𝐛𝐮 𝐂𝐢𝐭𝐲 𝐉𝐚𝐢𝐥 𝐭𝐨𝐝𝐚𝐲 𝐟𝐨𝐫 𝐚 𝐜𝐨𝐮𝐧𝐬𝐞𝐥 𝐯𝐢𝐬𝐢𝐭.

Significantly, the law provides that these visits or conferences may take place “at any hour of the day or, in urgent cases, of the night.” Access to counsel is therefore more than a matter of ordinary visiting hours; it is a legal safeguard intended to ensure that persons under detention continue to have meaningful access to legal assistance, subject to lawful and reasonable security regulations.

Legal representation does not begin and end inside the courtroom. Sometimes, protecting a client’s rights means going behind the walls where the client is detained—because the right to counsel remains a right even behind bars.

𝐀 𝐯𝐞𝐫𝐲 𝐛𝐮𝐬𝐲 𝐝𝐚𝐲 𝐭𝐨𝐝𝐚𝐲, 𝐰𝐢𝐭𝐡 𝐚𝐧𝐨𝐭𝐡𝐞𝐫 𝐜𝐨𝐮𝐫𝐭 𝐚𝐩𝐩𝐞𝐚𝐫𝐚𝐧𝐜𝐞. This time before the Regional Trial Court of Cebu City for a civil case involving breach of contract and damages.

Unlike criminal cases, where the State prosecutes an accused for an alleged offense and criminal liability is at issue, civil cases generally involve disputes over private rights and obligations and the appropriate relief that may be granted under the law. In this case, the controversy involves contractual obligations and a claim for damages.

A very busy day in the practice, moving from one legal matter to another, each requiring its own preparation, focus, and attention.

Cases involving family relationships are often among the most sensitive matters that come before our courts. Beyond the allegations and legal issues are individuals and families whose lives may be significantly affected by the outcome of the proceedings.
