🏡 Who’s Liable for Property Damage Caused by Natural Disasters — the Buyer or the Developer?
In the Philippines, we’re no strangers to earthquakes, typhoons, and floods and when they hit, one big question comes up for property buyers:
👉 “If my condo or house gets damaged by a natural disaster, who pays for the repairs?”

💡 THE GENERAL RULE
It depends on when the damage happens:
🔹 Before Turnover:
The developer is responsible for any loss or damage. The buyer hasn’t taken ownership yet, so all risks remain with the developer.
🔹 After Turnover or Acceptance:
Once the property is officially turned over and accepted (through documents or occupancy), the buyer becomes responsible for any future damages even from natural disasters.

🏗 WHY THIS MATTERS
Most buyers don’t pay attention to the “Risk of Loss” clause in their Contract to Sell or Deed of Sale.
This clause explains who bears the risk before and after the property handover and understanding it can save you from financial surprises during unexpected events like the recent earthquake in Cebu.
