Not All Doctors and Healthcare Providers Are Required to Register Their Data Protection Officers and Data Processing Systems

With the issuance of NPC Circular No. 2022-04 by the National Privacy Commission (NPC), doctors and healthcare providers must now carefully assess whether they are required to register their data processing systems and Data Protection Officers (DPOs).

Under the Data Privacy Act of 2012, patient records are classified as sensitive personal information, which means stricter compliance standards apply. Contrary to common belief, not all doctors are automatically required to register. However, mandatory registration arises when certain thresholds under Section 5 of NPC Circular No. 2022-04 are met.

PROTECTING PROPERTY RIGHTS IN SAME-SEX RELATIONSHIPS

In the case of Jennifer C. Josef v. Evalyn G. Ursua (G.R. No. 267469, February 5, 2025), the Supreme Court clarified the property rights of same-sex couples in the Philippines. The case involved a former couple who co-owned a house registered only in the respondent’s name, supported by a written acknowledgment of the petitioner’s 50% interest.

The High Court held that same-sex partners are governed by the general laws on co-ownership and contracts under the New Civil Code. It also held that in case the same-sex couple cohabited, their properties are considered co-owned.
