The (SC) has ruled that a duplicate or photocopy of original documents, whether in paper or electronic form, can be admitted as evidence in court, provided there is no genuine question regarding the original’s authenticity or fairness in using the copy.

In a Decision written by Chief Justice Alexander G. Gesmundo, the SC’s First Division upheld the conviction of Ybo Lastimosa (Lastimosa) for the murder of Ildefonso Vega, Jr. (Vega) in a case involving the use of a photocopy of Vega’s death certificate as key evidence.

Witnesses testified during trial that Lastimosa shot Vega in the head outside a cockpit in Cebu City. Vega’s wife also testified that Vega was already dead when she found him at the hospital. To support her testimony, the prosecution presented a photocopy of Vega’s death certificate, which confirmed that he died from gunshot wounds.

Convicted by the trial court of homicide and by the Court of Appeals of murder, Lastimosa argued before the SC that the prosecution failed to prove that the crime was committed because the original death certificate was not presented. He claimed that a photocopy, without comparison to the original for authentication, should not have been admitted as evidence.

The SC affirmed the Court of Appeals, sentencing Lastimoso to reclusion perpetua and ordered him to pay PHP 275,000 in civil indemnity and damages. It explained that under Rule 130, Section 4(c) of the 2019 𝘙𝘦𝘷𝘪𝘴𝘦𝘥 𝘙𝘶𝘭𝘦𝘴 𝘰𝘯 𝘌𝘷𝘪𝘥𝘦𝘯𝘤𝘦, a duplicate is admissible as the original unless there is a genuine question about the original’s authenticity or it would be unfair to use the duplicate.

This rule applies to both paper-based and electronic documents, reflecting the modern reality where duplicates are often as reliable as originals.

However, the SC emphasized that while a photocopy may be admissible, its weight or value depends on how well it corroborates or supports other available evidence.

In this case, the photocopy of the death certificate, combined with the testimonies of Vega’s wife and other eyewitnesses, sufficiently established that Vega died from gunshot wounds and that Lastimosa was responsible.

The has taken an important step towards modernizing legal processes by approving the Rules on Electronic Notarization (E-Notarization Rules) – a significant reform that leverages technology to make notarial services more accessible and efficient nationwide.

Under A.M. No. 24-10-14-SC, the Supreme Court En Banc approved the E-Notarization Rules and the Guidelines on the Accreditation of Electronic Notarization Facility Providers (Accreditation Guidelines). These rules introduce Electronic Notaries Public (ENPs), who are authorized to perform notarial acts for individuals located anywhere in the Philippines and, in certain cases, even abroad.

This expanded jurisdiction addresses a key limitation of the 2004 Rules on Notarial Practice (2004 Notarial Rules), where traditional notaries public were restricted to performing notarizations only within their territorial jurisdiction. By allowing ENPs to provide services across the country, the new rules ensure greater accessibility, particularly for those in remote or underserved areas.

The updated framework enables 3 forms of electronic notarization:
- In-Person Electronic Notarization (both principals and witnesses must be physically present)
- Remote Electronic Notarization (principals and witnesses may connect virtually to ENP via videoconferencing)
- Mixed In-Person and Remote

To enhance security, the E-Notarization Rules implements Multi-Factor Authentication (MFA) such as facial recognition, biometrics, and one-time passwords, in compliance with regulations set by the Bangko Sentral ng Pilipinas. The integrity of the electronic notarial book, or the register showing the chronological record of electronic notarial acts, is also safeguarded against tampering. Additionally, all data stored in the ENFs are protected under the Data Privacy Act.

The E-Notarization Rules applies exclusively to electronic documents in Portable Document Format (PDF) or Portable Document Format Archival (PDF/A). Paper documents with handwritten signatures, notarial wills, and depositions will continue to follow the 2004 Notarial Rules.

A part of the Strategic Plan for Judicial Innovations 2022-2027 (SPJI), this initiative aligns with the Supreme Court’s commitment to innovation and expanded access to justice by allowing notarization for electronic documents, including remote notarization through accredited software applications. This reform supplements the traditional mode of notarization under the 2004 Notarial Rules and marks a key milestone in the Court’s ongoing digital transformation.

The E-Notarization Rules takes effect 15 days after its publication on March 9, 2025.

Mga Chat Log At Bidyo, Pwedeng Gamiting Ebidensya Sa Mga Kasong Kriminal — Korte Suprema

Maaaring gamiting ebidensya sa mga kasong kriminal ang mga chat log at bidyo at hindi ito maituturing na paglabag sa right to privacy ng isang akusado, ayon sa Korte Suprema.

Sa Desisyon na isinulat ni Associate Justice Mario V. Lopez, napatunayang guilty ng Second Division ng Korte Suprema sa kasong qualified trafficking in persons sa ilalim ng Anti-Trafficking of Persons Act si Eul Vincent O. Rodriguez (Rodriguez), gamit ang Facebook at ibang online platform. Sinentensyahan siya ng life imprisonment at pinatawan ng multang nagkakahalaga ng PHP 2 milyon.

Taong 2014 nang mahuli si Rodriguez sa isang entrapment operation ng Anti-Human Trafficking Task Force ng Region 7 (Task Force) matapos alukin ang 14-anyos na si AAA sa hotel para gumawa ng live na hubo’t hubad na palabas.

Sinimulang imbistigahan ng Task Force si Rodriguez noong 2013 matapos makakuha ng tip mula sa United States Immigration and Customs Enforcement. Gamit ng isang decoy account, nakipag-ugnayan ang isang pulis kay Rodriguez sa iba't ibang online na platform na may record ng kanilang mga ugnayan.

Sa pagpatibay sa hatol kay Rodriguez, sinabi ng Korte na ang mga bidyo at recording ng mga chat logs ni Rodriguez at ng pulis ay maaaring tanggapin bilang ebidensya.

Tinanggihan ng Korte ang mga argumento ni Rodriguez na inadmissible ang nasabing ebidensya dahil sa paglabag sa kanyang privacy rights. Ang Republic Act No. 10173, o Data Privacy Act of 2012, ay nagpapahintulot sa pagproseso ng sensitibong personal na impormasyon upang matukoy ang kriminal na pananagutan ng isang tao at upang protektahan ang mga karapatan at interes ng mga tao sa paglilitis sa korte.

Paliwanag pa ng Korte, walang paglabag sa right to privacy dahil ang mga chat log at bidyo ay isinumite bilang ebidensya para masuri ang kanyang criminal liability para sa qualified trafficking.

Iginiit ng Korte na ang mga nakalap na ebidensya ay iprinisinta para ipakita ang paraan ni Rodriguez ng pakikipag-ugnayan sa mga dayuhan sa pamamagitan ng Skype o Facebook at pag-aalok ng mga menor de edad para sa sekswal na pananamantala.
