NO AUTOMATIC APPEALS ON ANNULMENT CASES GRANTED BY RTC—SOLGEN BERBERABE

Solicitor General Darlene Berberabe revealed that the Office of the Solicitor General (OSG) no longer automatically appeals cases involving annulment and declaration of nullity of marriage granted by regional trial courts and conducts an independent evaluation process to determine if the decision is worthy to be elevated before the Court of Appeals.

In a Senate budget hearing of the OSG 2026 proposed budget, Berberabe explained that this policy upholds the trend of Supreme Court decisions, which strikes a more liberal interpretation of the law regarding annulment and nullification of marriage.

“Ngayon po, gawa na rin ng recent trend sa mga usapin po ng divorce, kung ano po yung mga liberalized interpretation as well by the Supreme Court, yung mga moves po sa legislature as well, marami na rin pong mga rulings na parang nile-liberalize po yung rules of evidence on separation,” Berberabe said.
