Here are the instances in which entries in the birth certificate can be changed or corrected by the civil registrar:

✔️Correction of misspelled first or last name
✔️Correction of misspelled birthplace
✔️Correction of a mistake in the day or month of birth
✔️Correction of s*x
✔️Change of first name or nickname

Republic Acts 9048 and as amended RA 10172 now allows the the filing of a Verified Petition to the Civil Registrar to correct Clerical and/or Typographical Errors without going to court. Here are some of the requirements;

1. Contents of the petition

The petition should be in the form of a notarized affidavit. It should contain the following:

🚩Facts establishing the merits of the petition
🚩Information showing that you’re competent to testify about the matters stated in the affidavit
🚩The erroneous entry or entries to be corrected and the proposed correction(s)

2. Supporting Documents

To support your petition, you must attach the following documents to the affidavit:

🚩A certified true copy of the birth certificate or of the page of the registry book containing the entry or entries you want to be corrected or changed.
🚩At least two public or private documents showing the correct entry or entries, which will serve as the basis for the correction or change
🚩A certification from appropriate law enforcement agencies showing that you have no pending case or no criminal record
🚩Other documents that you, the city or municipal civil registrar, or consul general may consider relevant and necessary for the approval of the petition.

An affidavit of two disinterested persons is a legal document in the Philippines that is used to verify facts or documents, or to provide testimony in support of a legal claim. The two people who sign the affidavit must be truly disinterested in the matter at hand, meaning that they cannot have any personal stake in the outcome of the case or proceeding. The same document should be duly notarized.

Here are some of the uses of an affidavit of two disinterested persons in the Philippines:

✅To correct discrepancies in a person's name. For example, if a person's name is spelled differently in different government documents, they may be asked to submit an affidavit of two disinterested persons stating that they know the person and that the correct spelling of their name is the one that is being used in the affidavit.

✅To establish residency. For example, a person who is applying for a passport may be asked to submit an affidavit of two disinterested persons stating that they know the person and that they have been living in the Philippines for at least six months.

✅To support a petition for guardianship or adoption. For example, two people who know the child and the proposed guardian may be asked to sign an affidavit stating that they believe the guardian is a fit and proper person to care for the child.

✅To verify the authenticity of a document. For example, two people who have seen the original deed to a property may be asked to sign an affidavit stating that they believe the copy of the deed is a true and accurate copy.

✅To provide testimony in support of a legal claim. For example, two people who witnessed an accident may be asked to sign an affidavit describing what they saw.

What's the difference between Agricultural Free Patent and Certificate of Land Ownership or CLOA?

The main difference between an Agricultural Free Patent (AFP) and a Certificate of Land Ownership Award (CLOA) is their source of land. An AFP is a land grant awarded to natural-born Filipino citizens who have been in actual occupation and cultivation of alienable and disposable public lands for at least 30 years. FACTS:

In the early morning of New Year's Day of 1969 a taxicab (bearing 1968 plate no.TX-9395 and driven by Romeo N. Punzalan but operated by the Bay Taxi Cabowned by Gregorio N. Robles) struck ten-year old Normandy Padua on the national road in barrio Barretto, Olongapo City. The impact hurled Normandy about forty meters away from the point where the taxicab struck him, as a result of which he died.

Normandy's parents filed a complaint for damages (civil case 427-O) against Punzalan and the Bay Taxi Cab. The city Fiscal filed with the same court an information for homicide through reckless imprudence (criminal case 1158-O). TC in the civil case ordered defendant Punzalan to pay plaintiffs actual, moral,exemplary damages and attorney’s fees.

Trial Court in the criminal case convicted Punzalan of the crime of homicide through reckless imprudence. The court in its dispositive portion stated that “the civil liability of the accused has already been determined and assessed in the civil case.” The Paduas sought ex*****on of the judgment. This proved futile. They instituted an action against Robles to enforce his subsidiary responsibility under Article 103, RPC. Robles filed a motion to dismiss. Court granted the petition.

ISSUES:

Whether or not the judgment in the criminal case includes a determination and adjudication of Punzalan’s civil liability arising from his criminal act upon which Robles’ subsidiary civil responsibility may be based.

RESOLUTION:

YES. Paduas' complaint in civil case states a cause of action against Robles whose concomitant subsidiary responsibility, per the judgment in criminal case, subsists. The said judgment states no civil liability arising from the offense charged against Punzalan. However, a careful study of the judgment in question, the situation to which it applies, and the attendant circumstances, the court a quo, on the contrary, recognized the enforceable right of the Paduas to the civil liability arising from the offense committed by Punzalan and awarded the corresponding indemnity.
