⚖️ LEGAL ADVISORY: MAY "AUTHORITY TO SELL" PERO AYAW IPA-CHECK ANG LAND STATUS? RED FLAG YAN! ⚖️

Sa isang konsultasyon (na may pahintulot ng kliyente alinsunod sa Attorney-Client Privilege ), lumabas ang isang shady na senaryo: Ipinakita ng seller ang Special Power of Attorney (SPA) na may awtoridad siyang magbenta mula sa may-ari. Pero kapag humihingi ang buyer (si Client) ng sariling SPA o authorization upang magsagawa ng "Track and Trace" sa kasaysayan ng lupa at buwis, ayaw itong ibigay ng seller o agent. 🛑🤔

🚩 BAKIT KRITIKAL ANG "TRACK AND TRACE" AT BAKIT KAILANGAN MO NG SPA PARA RITO? 🚩

🔍 Ano ang Track and Trace sa Lupa? — Ito ang malalimang pag-imbestiga sa chain of ownership o ang pinagdaanang kasaysayan ng titulo mula sa unang may-ari hanggang sa kasalukuyan. Dito rin sinusubaybayan kung may mga nakatagong utang, naunang bentahan (double sale), o kaso ang lupa. 🕵️‍♂️📜

💼 Bakit Kailangan ng Buyer ng Sariling SPA o Authorization? — Dahil sa Data Privacy Act at sa mas mahigpit na polisiya ng Registry of Deeds at Assessor’s Office, hindi basta-basta ibinibigay ang kumpletong records, Certified True Copy ng lumang titulo, o detalyadong Tax History sa kahit sino lang. Kailangan mo ng legal na awtoridad mula sa panig ng nagbebenta upang payagan ka ng gobyerno na suriin ang kasaysayan ng ari-arian. 🏛️🔒

⚠️ Ang Nasa Likod ng Track and Trace: — Ang pinakitang "Authority to Sell" ng agent ay patunay lang ng kasunduan sa ilalim ng Civil Code Article 1878. Hindi nito masasagot ang mga sumusunod na isyu na tanging Track and Trace lang ang makakapaglantad:

Gisadong Buwis — Mga dekadang naipong delinquent real property taxes (amilyar) na mas malaki pa sa halaga ng lupa.

Fake Land Title Fraud — Titulo na biglang sumulpot nang walang legal na pinagbasehang lumang titulo.

Kasalukuyang Paglilitis — Mga nakasampang kaso sa korte o Notice of Lis Pendens na hindi agad nakatatak sa hawak nilang photocopy.

🛡️ Mag-imbestiga Upang Maprotektahan — Kapag hinadlangan ka ng nagbebenta na mag-verify at mag-Track and Trace sa pamamagitan ng pagkakait ng authorization, at pikit-mata mo itong tinangap, mawawalan ka ng karapatan bilang isang Buyer in Good Faith dahil ituturing ng batas na kapabayaan ang hindi mo pag-usisa. ⚖️❌

🙏 Tandaan: Ang tapat na nagbebenta ay walang dahilan para matakot sa Track and Trace. Kung malinis ang ari-arian, bukas-palad ka nilang bibigyan ng authorization para ma-verify ito! 🤝💰

A client recently sought advice after his elderly mother’s post‑operative care raised questions about compliance with laws protecting senior citizens. 👵🩺 At first, he believed the Expanded Senior Citizens Act (RA 9994) and Executive Order No. 110, Series of 2026, applied to the situation. 📄🤔

Upon review, it was clarified that these laws do not directly govern the case. Instead, the Department of Health Administrative Order No. 2017‑0001 — Policy Guidelines on the Standards of Care for Older Persons in All Healthcare Settings — provides the applicable framework. 🛡️📜

This AO requires healthcare facilities to uphold dignity, safety, and responsiveness in caring for older persons, integrating these standards into licensing and accreditation. ✨📋

Sobrang dali na lang mag-shopping at the comfort of our homes. 😉 Name it, online stores have it. Madalas, nakalagay 'FDA verified.' But if you verify talaga, hindi pala...😑

Dahil sa 𝐃𝐨𝐜𝐭𝐫𝐢𝐧𝐞 𝐨𝐟 𝐂𝐚𝐯𝐞𝐚𝐭 𝐄𝐦𝐩𝐭𝐨𝐫 (𝐿𝑒𝑡 𝑡ℎ𝑒 𝑏𝑢𝑦𝑒𝑟 𝑏𝑒𝑤𝑎𝑟𝑒), we don’t just take things at face value—we verify the evidence. 🔍

But wait, there's more. Under Section 11 (b) ng RA 9711, mahigpit na ipinagbabawal ang pagbebenta o pag-advertise ng anumang health product na walang "proper authorization" mula sa FDA.

Ang paglalagay ng pekeng registration number ay hindi lang panloloko—ito ay malinaw na paglabag sa batas (Misbranding). Ang mga mahuhuling lumalabag ay maaaring maharap sa:

✅ Pagkakulong (1 hanggang 10 taon)
✅ Malaking multa (₱50,000 hanggang ₱5,000,000)
✅ Permanenteng pagpapasara ng negosyo.

Makikita sa comparison na ito ang pagkakaiba ng 'marketing claims' sa 'legal facts':

🚩 𝐑𝐄𝐃 𝐅𝐋𝐀𝐆 para sa isang produkto na may nakasulat na registration number sa label, pero pag-search sa FDA portal, ang resulta ay 'No Record Found.' Sa ilalim ng Consumer Act (RA 7394), ito ay maituturing na Deceptive Sales dahil sa maling representasyon ng kalidad at sertipikasyon ng produkto.

✅ 𝐆𝐑𝐄𝐄𝐍 𝐂𝐇𝐄𝐂𝐊 naman para sa isang produktong dumaan sa tamang proseso. Ang label ay tumutugma sa opisyal na FDA database—indicator ito na ang produkto ay rehistrado at sumailalim sa safety standards.

❕❕❕ Huwag hayaang mauwi sa pagsisisi ang iyong online shopping dahil lang sa kakulangan ng due diligence. Bilang mga wais na consumer, obligasyon nating siguraduhin na ang bawat produktong binibili ay protektado ng batas. 📜🛡️

Consider this your 𝐃𝐮𝐞 𝐃𝐢𝐥𝐢𝐠𝐞𝐧𝐜𝐞 𝐆𝐮𝐢𝐝𝐞 in shopping, lalo na sa mga gamot, pagkain, at kosmetiko:

👣 Select Category: Piliin kung ito ay Food, Drug, Cosmetic, o Medical Device.
👣 Search the Detail: I-type ang Product Name o ang Registration Number (e.g., FR-40000...) na nakikita sa label.
👣 Analyze the Results: Kung 'No Record Found,' huwag nang ituloy ang checkout.

The Unified Legal Aid Service (ULAS) Office has issued ULAS Advisory No. 3, S. 2026 on the ULAS Board’s resolution to amend Section 2, Rule 12 of the ULAS Rules Manual, removing the requirement that pro bono legal aid services rendered by Philippine Lawyers Based Abroad (PLBA) must be related to Philippine Law.

Sa isang sesyon noong Miyerkules, Abril 8, 2026, isinantabi ng En Banc ng ang petisyon para sa certiorari na inihain ni Merson C. Calubag. Layunin ng petisyon na kuwestiyunin ang mga resolusyon ng Commission on Elections (COMELEC) na nagkansela sa kanyang Certificate of Candidacy (COC) para sa posisyon ng Sangguniang Kabataan Chairperson sa Barangay Magtangale, San Francisco, Surigao del Norte noong 2023 Barangay at SK Elections. Ang desisyon ay isinulat ni Associate Justice Antonio T. Kho, Jr.

Napag-alaman ng COMELEC na nagbigay si Calubag ng maling pahayag tungkol sa isang mahalagang detalye sa kanyang Certificate of Candidacy. Idineklara niya roon na wala siyang kamag-anak hanggang sa second civil degree of consanguinity or affinity sa sinumang kasalukuyang miyembro ng Sangguniang Barangay ng Barangay Magtangale, kahit na ang kanyang ina ay isa palang miyembro nito.

Ayon sa Seksyon 10 o tinatawag na “Anti-Dynasty clause” ng Republic Act No. 10742 (Sangguniang Kabataan Reform Act of 2015), ang isang kandidato para sa Sangguniang Kabataan ay wala dapat kaugnayan—hanggang second civil degree of consanguinity or affinity—sa sinumang kasalukuyang halal na opisyal sa pambansa, rehiyonal, panlalawigan, panlungsod, pambayan, o pambarangay na antas sa lugar kung saan siya tatakbo.

Kinilala ng Korte Suprema ang balangkas na itinakda sa RA 10742 bilang hakbang ng lehislatura para pigilan ang pagbuo at paglawak ng mga dinastiyang politikal sa bansa—bilang tugon sa panawagan ng Konstitusyon na bigyang-kahulugan ang political dynasty, kahit man lang sa antas ng barangay at Sangguniang Kabataan. Ayon pa sa Korte, ang ganitong batas ay nagbibigay-buhay sa patakarang nakasaad sa Konstitusyon na naglalayong ipagbawal ang mga dinastiyang politikal.
