Supreme Court Grants Petition for Nullity of Marriage Based on Psychological Incapacity in Landmark Case

In a significant decision, the Supreme Court of the Philippines has granted a Petition for Review on Certiorari, reversing the Court of Appeals’ decision and declaring the marriage of Ericson C. Cabutaje and Romelia A. Cabutaje void on the ground of psychological incapacity. The case, G.R. No. 248569, highlights the complexities and nuances of Article 36 of the Family Code.

The Supreme Court's decision emphasized that personal examination of the allegedly incapacitated spouse is not an absolute requirement and that expert testimony, along with collateral information from credible sources, can suffice to establish psychological incapacity. The Court found that Romelia A. Cabutaje's actions and personality structure, consistent with histrionic personality disorder with anti-social features, demonstrated a grave and incurable inability to fulfill essential marital obligations.

This ruling underscores the importance of understanding psychological incapacity as a valid ground for nullity of marriage and provides crucial guidance on the evidence required to prove such incapacity.

Key Takeaways:

- Personal examination is not mandatory for psychological incapacity cases.
- Expert testimony and collateral information are valuable evidence.
- Grave, incurable, and juridically antecedent psychological incapacity must be established.

This decision reaffirms the Court's commitment to protecting the sanctity of marriage while acknowledging situations where psychological incapacity renders a marriage void.

Mayo Law Office is committed to staying informed on the latest legal developments and providing expert guidance on family law matters.
