The (SC) 𝘌𝘯 π˜‰π˜’π˜―π˜€ has approved the π˜™π˜Άπ˜­π˜¦π˜΄ 𝘰𝘯 𝘍π˜ͺ𝘭π˜ͺ𝘱π˜ͺ𝘯𝘰 𝘚π˜ͺ𝘨𝘯 π˜“π˜’π˜―π˜¨π˜Άπ˜’π˜¨π˜¦ (π˜π˜šπ˜“) 𝘐𝘯𝘡𝘦𝘳𝘱𝘳𝘦𝘡π˜ͺ𝘯𝘨 π˜ͺ𝘯 𝘡𝘩𝘦 π˜‘π˜Άπ˜₯π˜ͺ𝘀π˜ͺ𝘒𝘳𝘺 (π˜π˜šπ˜“ π˜™π˜Άπ˜­π˜¦π˜΄) implementing Republic Act No. 11106, or π˜›π˜©π˜¦ 𝘍π˜ͺ𝘭π˜ͺ𝘱π˜ͺ𝘯𝘰 𝘚π˜ͺ𝘨𝘯 π˜“π˜’π˜―π˜¨π˜Άπ˜’π˜¨π˜¦ 𝘈𝘀𝘡.

The π˜π˜šπ˜“ π˜™π˜Άπ˜­π˜¦π˜΄, formulated to guarantee d/Deaf Filipinos equal, relevant, and effective access to justice, shall apply in all courts proceedings and cases involving d/Deaf Filipinos to ensure their participation at any litigation stage and to grant them right to choose their preferred mode of communication.

The π˜π˜šπ˜“ π˜™π˜Άπ˜­π˜¦π˜΄ provide, among others, the procedure in appointing FSL Interpreter and/or Deaf Relay Interpreter, the guidelines in FSL Interpreting in court proceedings, and the ethical standards and professionalism that FSL Interpreter and/or Deaf Relay Interpreter must observe in courts.

Prior to their appointment as FSL Interpreter and/or Deaf Relay Interpreter, he or she must meet the qualifications set in the π˜π˜šπ˜“ π˜™π˜Άπ˜­π˜¦π˜΄ and must be accredited by the Office of the Court Administrator.

The π˜π˜šπ˜“ π˜™π˜Άπ˜­π˜¦π˜΄ were drafted by the Technical Working Group headed by SC Associate Justice Japar B. Dimaampao as Chairperson and Associate Justice Jose Midas P. Marquez as Vice Chairperson. It shall take effect on December 15, 2025 following its publication in two newspapers of general circulation on November 29, 2025, and on the SC website.

SC: PLDT Employees Engaged in Installation, Repair, and Maintenance of Service Lines are Regular Employees |

The Supreme Court has ordered the regularization of employees of PLDT, Inc. (PLDT) engaged in installation, repair, and maintenance services of PLDT lines.

In a Decision penned by Associate Justice Rodil V. Zalameda, the Supreme Court’s First Division dismissed the consolidated petitions for review on certiorari filed by Manggagawa sa Komunikasyon ng Pilipinas, PLDT, and Silvestre Bello Ill (Sec. Bello), in his capacity as then Secretary of the Department of Labor and Employment (DOLE). The petitions assailed the rulings the Court of Appeals (CA) affirming, with substantial modifications, the resolutions issued by Sec. Bello finding labor violations by PLDT and its contractor.

PLDT, a corporation engaged in the telecommunications business, engaged the services of several contractors and sub-contractors to provide services in various areas or phases of its operations.

In affirming the rulings of the CA, the Court clarified that labor contracting is not per se illegal, following Article 106 of the Labor Code expressly allowing an employer to engage in legitimate labor contracting, which the DOLE implements through DO 18-A and DO 174-2017.

An employer is not necessarily engaged in labor-only contracting whenever it farms out specific jobs, works, or services, stressed the Court.

Reiterating its 2010 ruling in Aliviado v. Procter & Gamble Phils, Inc. the Court held that it is management prerogative to farm out any of its activities, regardless of whether such activity is peripheral or core in nature. For such outsourcing to be valid, it must be made to an independent contractor because the current labor rules expressly prohibit labor-only contracting.

SC Reminds Judges, Lawyers to Use Gender-Fair Language |

A judge and a prosecutor were called out by the Supreme Court for using non-gender-fair language in the course of an annulment case.

In a Decision penned by Senior Associate Justice Marvic M.V.F. Leonen, the Supreme Court’s Second Division took exception to the language used by a Pasig City Regional Trial Court (RTC) judge and a prosecutor during court proceedings involving the petition for declaration of nullity of marriage filed by Aiko Yokogawa-Tan (Yokogawa-Tan).

While the Court reversed and set aside the lower courts’ rulings and declared Yokogawa-Tan’s marriage null and void after finding clear and convincing evidence that Tan was psychologically incapacitated to fulfill his essential marital obligations, the Court also took the opportunity to remind the judge and the prosecutor to be circumspect in their language.

The Court observed that non-gender-fair language was used by both the judge and the prosecutor in the case.

Approved by the Supreme Court En Banc in 2022, the Guidelines was a result of the Court’s efforts, led by its Committee on Gender Responsiveness in the Judiciary or the CGRJ, to combat sexist language in the Judiciary.
