Ano Ba Talaga ang Kaibahan ng Zonal Value at Market Value?

Maraming property buyers at sellers ang nagugulat kapag nalaman nila ito.

Akala nila:

Kung magkano ang Zonal Value — iyon na ang presyo ng lupa.

Pero sa realidad…

Magkaibang-magkaiba ang Zonal Value at Market Value.

At kung hindi mo ito naiintindihan,
pwede kang malugi o magbayad ng mas malaking tax.

Let’s break it down.



1️⃣ Ano ang Zonal Value?

Ang Zonal Value ay ang minimum property value na itinatalaga ng gobyerno para sa taxation purposes.

Ito ay dine-determine ng
Bureau of Internal Revenue (BIR).

Ginagamit ito para sa:

• Capital Gains Tax
• Documentary Stamp Tax
• Estate Tax
• Donor’s Tax

Importanteng tandaan:

Hindi ito ang totoong bentahan ng property sa market.

It’s simply the government’s baseline value for taxes.



2️⃣ Ano naman ang Market Value?

Ang Market Value naman ay ang aktwal na presyo kung magkano kayang ibenta o bilhin ang property sa kasalukuyang market.

Ito ay naka-base sa:

• Demand ng buyers
• Location
• Developments sa area
• Infrastructure projects
• Supply ng properties

Sa madaling salita:

Ito ang totoong presyo na napagkakasunduan ng buyer at seller.



3️⃣ Bakit Mas Mataas Madalas ang Market Value?

Dahil ang Zonal Value ay hindi palaging updated.

Habang tumataas ang demand sa isang lugar —
tumataas din ang presyo sa market.

Pero ang Zonal Value minsan years bago ma-update.

Resulta?

Halimbawa:

Zonal Value: ₱5,000/sqm
Market Value: ₱12,000–₱18,000/sqm

Malayo ang pagitan.



4️⃣ Critical Ito Kapag Bibili o Magbebenta ng Property

Dahil sa Pilipinas, ang taxes ay kadalasang kinukuwenta sa mas mataas na value sa dalawa.

Either:

• Selling Price
• Zonal Value

Kung alin ang mas mataas, doon ibabase ang tax.



5️⃣ Kaya Maraming Nalilito sa Real Estate Deals

May buyers na nagsasabing:

“Bakit mahal? Eh ang zonal value mas mababa naman.”

Pero ang totoo:

Ang zonal value ay hindi presyo ng property.

Ito ay reference lang ng gobyerno para sa taxes.



Real Estate Reality

Kung gusto mong maging mas matalinong buyer o seller,
kailangan mong maintindihan ang difference ng dalawang ito.

Dahil sa real estate:

Ang hindi mo alam… pwedeng maging mahal na pagkakamali.

𝐌𝐨𝐬𝐭 𝐛𝐮𝐲𝐞𝐫𝐬 𝐭𝐡𝐢𝐧𝐤 𝐭𝐡𝐞𝐲 𝐨𝐧𝐥𝐲 𝐡𝐚𝐯𝐞 𝐭𝐰𝐨 𝐜𝐡𝐨𝐢𝐜𝐞𝐬: 𝐦𝐚𝐠𝐡𝐢𝐧𝐭𝐚𝐲 𝐨𝐫 𝐦𝐚𝐠 𝐠𝐢𝐯𝐞 𝐮𝐩.

But the truth is, you have a process.

📌 Under PD 957, buyers are protected when developers fail to deliver projects based on approved plans and timelines.
📌 Under RA 6552 (Maceda Law), buyers who have paid at least 2 years of installments may be entitled to a cash surrender value if the contract is cancelled.

But here’s the key: Refund is not automatic. It becomes possible when you take the right steps.

✅ NEXT STEPS FOR BUYERS AFFECTED BY DELAY:

1) Check your Contract to Sell (CTS)
Look for the promised turnover date, grace period, and delay clauses.

2) Request an official written update from the developer
Don’t rely on verbal promises or “next month daw.”

3) Document everything. Emails, announcements, demand letters, progress reports, receipts.

4) Decide your direction early
Do you want to:
✔ continue and demand a firm timeline?
✔ restructure payments?
✔ transfer / assume the unit?
✔ or cancel and explore refund options?

5) Send a formal written demand / notice
This is where buyers usually fail. If you don’t put it in writing, you lose leverage.

6) File a complaint with DHSUD if needed
If the delay becomes unreasonable and negotiations fail, DHSUD is the proper venue for buyer protection cases under PD 957.

The biggest mistake is waiting too long, missing deadlines, and only reacting when penalties pile up.
