Starting April 23, 2020, pursuant to the executive order signed by President Trump today, the entry to the U.S. of certain immigrants is suspended for a period of 60 days, until June 22, 2020. Bear in mind that the order applies to folks who are outside of the U.S. seeking to immigrate. Below is a breakdown of the order.
Who can still enter the U.S.?
- Spouses and children (unmarried and under 21) of U.S. citizens applying for immigrant visas
- Fiancés of U.S. citizens applying for K-1 visas
- Anyone who already has a green card or immigrant visa
- Anyone applying for an immigrant visa as a medical professional
- Applicants for the EB-5 visa
- Members of the U.S. military and their spouses and/or children
- Applicants for special immigrant visas and their spouses and/or children
- Anyone with a nonimmigrant visa (i.e. tourist, student, ESTA, H-1B, L-1, H-2B, etc.)
Who is not allowed to enter the U.S. for the next 60 days?
- Anyone who is outside the U.S. and is applying for an immigrant visa on any other basis not mentioned above (i.e. parents, siblings, adult and married children of U.S. citizens, spouses and children of permanent residents, etc.)
If I am already in the U.S. and applying for adjustment of status, will I be affected?
- No. You can still apply and your application will continue to be processed.
