HOW TO TRANSFER TAX DECLARATION TO THE BUYER ๐Ÿ  (With timeline guide)

If you bought a property with TAX DECLARATION ONLY, hereโ€™s the proper process:

STEP 1: Execute a Notarized Deed of Absolute Sale
Immediately after payment. Make sure seller signs complete documents and IDs match the tax dec.

STEP 2: Pay BIR Taxes within 30 days from notarization
Usually required:
โ€ข Capital Gains Tax (6%) โ€“ normally sellerโ€™s obligation
โ€ข Documentary Stamp Tax (1.5%) โ€“ usually buyer
โ€ข Other BIR requirements (TIN of both parties, etc.)

You must secure: BIR Certificate Authorizing Registration (CAR)

If late, penalties and interest apply.

STEP 3: Pay Transfer Tax within 60 days from signing
Pay at the City/Municipal Treasurerโ€™s Office.
Rate varies per LGU (usually around 0.5%โ€“0.75%).

STEP 4: Update at Assessorโ€™s Office after completing tax payments

Submit:
โ€ข Notarized Deed of Sale
โ€ข BIR CAR
โ€ข Official Receipts of taxes paid
โ€ข Latest Tax Declaration
โ€ข Tax Clearance

Processing time usually 2โ€“4 weeks (depends on LGU)

Old tax dec will be cancelled. New tax declaration will be issued under buyerโ€™s name.

IMPORTANT REMINDERS โš ๏ธ

โœ”๏ธ Tax Declaration is NOT proof of ownership like a Torrens Title.
โœ”๏ธ It only proves who is paying real property tax.
โœ”๏ธ Always check land classification (Is it Alienable & Disposable?)
โœ”๏ธ Verify if property has pending titling or overlapping claims.
โœ”๏ธ Check for unpaid real property taxes.

For tax-dec properties, due diligence is EVERYTHING.

Consult a licensed broker or lawyer before buying. Better to spend on verification than spend years in court.

First, donโ€™t panicโ€”but also donโ€™t stay silent.

Because paying your equity doesnโ€™t automatically mean immediate turnover.
What it means is this:

โœ… You already fulfilled your part.
Now itโ€™s time to make sure the developer fulfills theirs.

Here are your next steps:

1) Request an official Turnover Schedule (in writing)
Not โ€œverbal updates.โ€ Not โ€œnext month daw.โ€ Get it documented.

2) Ask for the Punchlist / Unit Readiness Status
Is your unit completed? Under inspection? Pending permits? Or delayed due to construction?

3) Check your Contract + Delivery Date Clause
Most buyers forget this part.
The contract will tell you if youโ€™re still within the allowed delivery period.

4) Send a formal follow-up letter/email
Because once itโ€™s documented, you have stronger legal ground if the delay becomes unreasonable.

5) If the delay is beyond the legal grace periodโ€ฆ
You may have the right to demand action, compensation, or even explore cancellation/refund options depending on the case.

You paid on time.
So you deserve clarity on time.

Simple. Kapag mother title pa rin at walang proper subdivision, madaling maibenta ang parehong lupa sa ibang tao.

Ganito ang common scenario:
โ€ข Buyer 1 โ€“ Nag downpayment, may deed of sale
โ€ข Buyer 2 โ€“ Nag full payment, na-register agad

Ngayonโ€ฆ sino ang mas protected?

โš–๏ธ Under Philippine law: Sa double sale ng real property, ang mas may advantage ay:

1๏ธโƒฃ Yung unang nakapag-REGISTER sa Registry of Deeds (good faith)
2๏ธโƒฃ Kung walang registration โ€“ yung unang nakakuha ng possession
3๏ธโƒฃ Kung pareho wala โ€“ yung may older deed (good faith)
