“Tax Declaration Is Not Ownership: A Legal Reality Check for Property Buyers”
Believing that a Tax Declaration (Tax Dec) property can be easily titled is one of the most expensive assumptions a buyer can make.
Many buyers purchase Tax Dec land thinking conversion is quick — only to later discover:
• No cadastral survey
• Overlapping boundaries
• Multiple heirs or claimants
• Government ownership or road right-of-way issues
• Property not qualified for titling
If you intend to convert Tax Declaration land into titled property, this is the proper process:
1️⃣ Confirm the land is Alienable and Disposable (A&D) with DENR/CENRO/PENRO.
2️⃣ Secure an approved Survey Plan and Technical Description from a licensed Geodetic Engineer.
3️⃣ Verify the chain of Tax Declarations at the Assessor’s Office.
4️⃣ Obtain Barangay/LGU certifications confirming possession and absence of dispute.
5️⃣ File for Judicial or Administrative Titling, as applicable.
6️⃣ Upon approval, register with the Registry of Deeds for issuance of OCT/TCT.
⚠️ Reality: Titling is not automatic. It can take months — even years — depending on legal and technical issues.
