Q: Atty., nawala po ang titulo ng lupa namin. Pwede po ba kaming pumunta agad sa Registry of Deeds para kumuha ng replacement?

A: Hindi po. Kung ang Owner's Duplicate Certificate of Title ay nawala o nasira, hindi po maaaring basta humingi ng panibagong kopya sa Registry of Deeds.

Ayon sa Sec. 109 ng Property Registration Decree (P.D. No. 1529), kinakailangan ang court order matapos ang tamang judicial proceedings upang makakuha ng bagong Owner's Duplicate Certificate of Title.

Paano ang proseso?
1. Ihanda ang mga requirements.
Maaaring kabilang dito ang:
✔️ Certified True Copy ng titulo mula sa Registry of Deeds
✔️ Affidavit of Loss
✔️ Tax Declaration at Tax Clearance (kung kinakailangan)
✔️ Iba pang dokumentong hinihingi depende sa sitwasyon.

2. Maghain ng Petition sa tamang RTC.
Komunsulta sa abogado upang makapaghain ng Petition for Issuance of New Owner's Duplicate Title.

3. Dumaan sa court proceedings.
Magkakaroon ng hearing upang mapatunayan na tunay na nawala o nasira ang Owner's Duplicate at walang ibang taong may mas mataas na karapatan dito.

4. Maglalabas ng Court Order.
Kapag napatunayan ang petition, mag-uutos ang korte sa Registry of Deeds na mag-isyu ng bagong Owner's Duplicate Certificate of Title.

5. Ipresenta ang Court Order sa Registry of Deeds.
Pagkatapos nito, saka pa lamang maaaring ma-isyu ang bagong Owner's Duplicate Certificate of Title.

⚖️ Mahalagang paalala: Huwag magpagawa ng "bagong titulo" sa mga fixer o taong nangangakong mabilis ang proseso. Ang tamang proseso ay dumadaan sa korte.

Kung nawala ang titulo ng inyong lupa at hindi ninyo alam kung saan magsisimula, makabubuting kumonsulta muna sa isang abogado upang malaman ang tamang legal na hakbang.

Q: Atty., what should I bring for notarization or legal consultation?

📄 Bring the document you want to have notarized. Please ensure that it is complete. Bring at least two (2) copies of the document, as one copy will be retained by the Notary Public for their records.
🪪 Bring at least one (1) valid government-issued ID with your photo, signature and address.
