LA NORMA ES CLARA AL SEÑALAR QUE EL MINISTERIO PÚBLICO DEBE MOTIVAR SU REQUERIMIENTO DE PRISION PREVENTIVA Y CUMPLIR LOS TRES PRESUPUESTOS : GRAVES Y FUNDADOS ELEMENTOS DE CONVICCIÓN, LA SANCION A IMPONERSE SEA SUPERIOR A 5 AÑOS Y PELIGRO PROCESAL.
SI NO SE CUMPLE EL PRIMER PRESUPUESTO , POR CONSIGUIENTE LOS DEMAS PRESUPUESTOS NO PODRAN SER DEBATIDOS YA QUE DEBEN CUMPLIRSE COPULATIVAMENTE TODOS.
