The Ministry of Justice has published updated Probate guidance, intended to assist people manage simple estates and identify where professional guidance is needed.

The management of estates is not one-size-fits-all. As an executor or administrator of an estate, you may be able to complete most or all of the administrative work yourself. You can agree with your legal team on who will do what part of the process, so that you have the support you need without paying for services you are able to manage yourself.

Recently a couple of homeowners tried to sue their bank for paying their overdue rates to the council. They had been refusing to pay their rates on principle, and the bank sent them a letter saying that if the arrears continued, the council might require the bank to pay them directly from the homeowners' bank account.

If you have a mortgage registered against your property, you are obliged to keep your rates and insurance premiums current. Not doing so puts you at risk of your insurance being cancelled, or the property being assumed abandoned and being sold by the council. To reduce these risks, as a last resort measure, the bank that holds a mortgage over your property can direct funds from your bank account to meet these obligations.

No one wants the inconvenience and default costs that come with arrears. If you are having difficulty meeting your payments, ask your council rates team about a payment plan. Failing that, you can ask your bank for assistance, or have a budget advisor or lawyer assist as a go-between in those discussions.

Before you sign that sale and purchase agreement, send it to us! Please don't just throw in a bunch of common conditions and hope for the best. Now is the time to check that the terms and conditions are the right fit for you, not next week ;)

A will lets you say how you want your property dealt with when you die. Once you die, everything you own, and everything you owe, is called your estate. This pamphlet tells you about making a will and how your estate is administered.

How can a property be sold if the owner has passed away?

If the property was jointly owned with another person, the surviving owner is entitled to full ownership as of right and becomes the sole seller.

But if the person who passed away was the sole owner of the property, or the sole owner of a specific share of the property (e.g. 50%), their share now belongs to their estate. The sale will be conducted by the administrators/executors of their estate. They will require either "Grant of Probate" or "Letters of Administration" from the High Court to confirm their signing authority on behalf of the estate.
