The Retirement Villages Act 2003 (the Act) sets out the rights and obligations of retirement village operators, residents, and anyone considering moving into a retirement village.

The Government is in the process of reviewing the Retirement Villages Act 2003. The review is looking at whether the law currently gives enough protection to residents, while keeping retirement villages sustainable. The changes proposed are aiming to improve resident protection, rebalance the rights and responsibilities of residents and retirement villages, and help the sector continue to grow and be able to offer a range of housing options for New Zealand’s increasing aging population.

These proposed changes are not law as of yet, and a draft bill is estimated to be introduced to parliament mid-2026. Here’s a summary of what changes are being proposed:

New Zealand’s new roadside drug testing regime is now in force, and drivers should be prepared to see it used more widely across the country.

For many years, drug driving enforcement has largely depended on Police forming a suspicion that a driver may be impaired, followed by a compulsory impairment test and, in some cases, a blood test.

The new regime adds a separate infringement-based process. In practical terms, Police can now use oral fluid screening tests at the roadside to check for recent drug use, even where there is no obvious sign of impairment.

A positive roadside result does not automatically mean a conviction, or even an immediate infringement notice. The process has several steps, and drivers should understand what Police can require, what happens after a positive result, and what limited defences may be available.

A common thing we encounter in practice are Kiwis believing that the Property (Relationships) Act 1976 (PRA) only applies to married couples. We’re here to tell you if you didn’t know, that this is not the case.

In New Zealand, if you’ve been living with your partner for three years or more, you may be treated the same as a married couple under law. This means that if your relationship ends, any relationship property could be subject to equal division between the two of you regardless of who owns it.

On Friday, Team Godfreys swapped their keyboards for golf clubs and took to Harewood Golf Course for Life Education Trust - Canterbury's Charity Golf Day.

Playing the day in Ambrose format, the team swung their way through 18-holes amongst other Christchurch businesses to fundraise for the amazing classroom programmes Life Ed Canterbury provide our tamariki.

Team Godfreys believe there is probably no better way to raise money for a such great cause, than a day out on the golf course. Life Education is a charity that does not receive government funding. Join us in supporting Life Ed, and we’ll see you out on the course next year!

Last week Raaj and Brooke attended the Law Alliance NZ (LANZ) event in Russell, and it proved to be a fantastic experience from start to finish.

The event featured an outstanding line up of speakers, including Dame Claudia Orange, Hon Christopher Finlayson, Matt Watson, among many others. Their messages were engaging and thought provoking. It was also a valuable opportunity to spend time in Russell and gain a deeper understanding of the area’s history and significance.

Highlights included a warm welcome to Waitangi with a guided tour, a boat cruise where attendees learned more about the region’s history, and the opportunity to network with other Lawyers and Practice Managers.

Overall, it was a memorable and valuable experience.

Thank you to the LANZ Executive for organising a wonderful event.

Great to get the team together on Friday for a bit of healthy competition at Serve Social’s Game Show.

A fun way to step away from the desk, test some trivia knowledge, and spend time together outside the office, something we value as a team at Godfreys.

It also doubled as a chance to mark Oliver Lee’s last day with us. We thank him for his contribution to the firm and wish him all the best as he heads into the world of finance.
