A key change introduced by the Employment Relations Amendment Act 2026 is a new “gateway test” for determining whether a worker is an employee or a contractor. The test is intended to reduce uncertainty under the previous legal frameworks. The new test applies from 21 February 2026 when the Amendment came into force and applies to all existing or new agreements.

When one partner needs residential care, the financial impact can affect both people. This often comes as a surprise. Many couples think of certain assets as belonging to one person only, especially KiwiSaver, savings, inheritances, or property owned before the relationship.

For Residential Care Subsidy purposes, the position can be broader. The legislation says that assets can include the assets of the person being assessed and their spouse or partner, if those assets are capable of being realised.

The starting point in New Zealand is that a person is responsible for paying for their own residential care. However, government support may be available depending on the person’s age, care needs, assets and income.

The main form of support is the Residential Care Subsidy. This helps with the cost of long-term residential care in a rest home or hospital. It is paid directly to the care provider by Health New Zealand, not to the resident personally.
