Have a criminal conviction or another issue that could affect your character assessment? Australia is changing the rules used to decide whether you can enter or stay in the country.
From 31 October 2026, Australian immigration officials will use a stricter approach when assessing character concerns.
Three important changes are:
• Officials will be able to consider whether there’s a possibility that someone could engage in concerning behaviour. They won’t need to believe that the behaviour is likely to happen.
• A short visit or compassionate reason for travelling may carry less weight. Officials will focus more closely on the possible risk and whether visa conditions could manage it.
• More types of domestic and family violence will be considered, including stalking, image-based abuse, controlling behaviour and breaches of court orders. This can also include behaviour involving caregivers, relatives and culturally recognised family relationships.
A conviction doesn’t automatically prevent you from travelling to Australia. Each case depends on the person’s full history, circumstances and supporting evidence.
If you’re a New Zealand citizen with a conviction, pending charge or another possible character concern, get advice before you travel or apply for an Australian visa.
