This application involved significant character concerns and required a carefully prepared character waiver request. Domestic violence is never acceptable.

It is deeply sad that, after surviving violence, a person may then face further fear and uncertainty about their immigration status. Having to explain painful experiences, gather evidence, and prove why you should not be forced to leave New Zealand can feel like another layer of trauma.

Their residence application was submitted on 6 May 2026 and approved on 18 June 2026.

Resdience approved!!!!!
This lady has faced years of uncertainty, family violence, visa challenges, and the fear of being separated from the life she built in New Zealand.

Today, the Tribunal recognised the exceptional humanitarian circumstances in her case, including her role as the sole caregiver of her New Zealand citizen child with complex needs, the family violence she experienced, and the limited support available to her overseas.

The appeal was allowed, and the Tribunal ordered that she be granted a resident visa.

A powerful reminder: never give up when there are strong humanitarian grounds and a genuine reason to remain in New Zealand.

A wonderful win for TDA Immigration and Student Services this week.

Many couples come to New Zealand to work hard, contribute to our communities, and build a better future. Sometimes, while they are here, they receive the blessing of welcoming a child.

However, when circumstances change, families can face unexpected immigration challenges. A child born or living in New Zealand may not automatically qualify for a visa just because one parent is able to support a partner’s visa.

This week’s approval was a great result for one of our families, and an important reminder:

Just because your visa allows you to support your partner, it does not always mean you can support a child. The rules can be different for partners and dependent children.

If your family circumstances have changed, especially if you have had a baby while in New Zealand, it is important to get advice early so your child can remain lawful in New Zealand.
