Did you know you can now build a small standalone dwelling (up to 70mΒ²) without a building consent?

The Building and Construction (Small Stand-alone Dwellings) Amendment Act came into force in early 2026, but there are strict conditions, and penalties apply if you get them wrong.

All three conditions must be met:
- The dwelling must be of a simple design and comply with the Building Code
- The work must be carried out or supervised by a licensed building professional
- The council must be notified before work begins and again at completion

Fail to meet any of these, and you could face real penalties.

A major shift in NZ property law is now in effect.

The government has amended the Overseas Investment Act to allow Active Investor Plus (AI+), Investor 1, and Investor 2 visa holders to purchase or build a home in New Zealand, even if they don't plan to live here permanently.

This opens a new pathway for committed investors, including:
- Existing homes valued at $5M+ (subject to OIO consent)
- New builds across NZ (no price floor, OIO consent required)

OIO consent must still be obtained before purchasing, and the legal requirements around eligibility, conditions, and compliance are specific and serious.

Big change for NZ property transactions, effective 21 April 2026.

The standard Agreement for Sale and Purchase of Real Estate (ASPRE) has been updated. The new Eleventh Edition brings changes around privacy compliance, vendor warranties, and OIA consent conditions.

What this means for you:
- New privacy rules require clearer disclosure of how your personal information is collected and used
- Vendor warranties have been updated, know what you're signing
- Any changes to the standard form must now be "reasonably identifiable" (no hidden alterations)
