Subject: Request for Sri Lanka to Accede to the Hague Apostille Convention (1961)

Your Excellency,

I write to you as a Sri Lankan-born legal professional, a holder of an LLB degree from a United Kingdom university, and a long‑term resident of Norway. While I now live abroad, my bond with Sri Lanka remains deep, and I follow the country’s legal and administrative developments with great concern and hope.

I respectfully draw your attention to a matter of significant practical and economic importance: Sri Lanka’s absence from the Hague Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (the Apostille Convention). To date, Sri Lanka has neither signed nor ratified this treaty. Consequently, Sri Lankans, foreign investors, and members of the Sri Lankan diaspora face a cumbersome, costly, and time‑consuming consular legalisation process whenever they need to use public documents (e.g., birth certificates, marriage certificates, academic diplomas, court orders, or notarised commercial documents) in any of the 129 member countries.

Why Sri Lanka should accede without delay

1. Ease for citizens and the diaspora – Millions of Sri Lankans work, study, or live overseas. Under the current system, obtaining consular legalisation from the Ministry of Foreign Affairs and the relevant embassy is slow and expensive. Accession would replace this with a single apostille certificate issued by a designated authority in Sri Lanka, instantly recognised by all member states.

2. Attracting foreign investment – International businesses and investors find legalisation requirements a hidden barrier. Removing it signals that Sri Lanka is modernising its legal infrastructure, making contracts, corporate registrations, and arbitration awards easier to process across borders.

3. Cost and time reduction – Legalising a single document can cost hundreds of dollars and take weeks. An apostille typically costs a small fee and takes a few days. For students, job seekers, and families handling inheritances or marriages abroad, the difference is transformative.

4. Alignment with international standards – The Convention is one of the most successful and widely adopted treaties in private international law. Neighbouring countries such as India, Pakistan, Bangladesh, and the Maldives are already members. Sri Lanka risks being left behind as a legal outlier.

5. Judicial and administrative efficiency – Sri Lankan courts and government departments would no longer need to examine foreign legalisations for documents coming from member states. Mutual recognition is simplified, reducing bureaucratic bottlenecks.

My perspective as a legal professional

Having studied UK law, I am familiar with how the Apostille Convention streamlines cross‑border transactions. Living in Norway – another member country – I see how easily a Norwegian citizen can use a birth certificate in Germany or a court order in Canada. Sri Lankan professionals and students face exactly the opposite: they must pay for translation, notarisation, Foreign Ministry verification, and embassy attestation. This is an unnecessary tax on our people’s global mobility and aspirations.

I appreciate that accession requires domestic preparation – designating a competent authority, training staff, and updating rules – but many countries with far fewer resources have successfully implemented the Convention. The benefits far outweigh the transitional costs.

Respectful request

Therefore, I respectfully request that Your Excellency direct the Ministry of Foreign Affairs, the Ministry of Justice, and the Attorney General’s Department to:

1. Prepare and submit to Parliament the necessary instruments for Sri Lanka to accede to the Hague Apostille Convention.

2. Designate a responsible authority (e.g., the Consular Affairs Division of the Ministry of Foreign Affairs) to issue apostilles.

3. Launch a public awareness campaign to inform citizens, lawyers, and businesses about the new procedure.

Sri Lanka has a rich legal heritage. Joining the Apostille family would be a relatively simple but powerful step toward modernisation, diaspora engagement, and economic recovery. I stand ready, as a legal professional, to offer any pro bono assistance or comparative research that may support this effort.

I am Nadarajah Sethurupan, a holder of a Bachelor of Laws (LLB) degree from the United Kingdom, currently residing in Norway. I write to you not only as a legal professional but as a son of the soil, deeply connected to the Northern Province of Sri Lanka. I am compelled to invoke your high office’s constitutional duty to uphold the rule of law in light of egregious, systematic, and unlawful acts perpetrated by state authorities in the Thunnalai area of Valikamam North, Jaffna.

1. The Precedent: The Meethotamulla Judgment (Supreme Court, March 2026)

I draw your immediate attention to the landmark judgment delivered by the Supreme Court of Sri Lanka on March 31, 2026 (today), concerning the Meethotamulla garbage dump. In that judgment, the Supreme Court unequivocally held that the Colombo Municipal Council, the Urban Development Authority, the Western Province Waste Management Authority, and the Central Environmental Authority violated the Fundamental Rights of residents through unlawful conduct and improper garbage disposal practices.

The Court found that the unlawful dumping of waste from 2009 to 2017 infringed upon the Constitutional rights guaranteed under Article 12(1) (Equality before the law) of the Constitution of the Democratic Socialist Republic of Sri Lanka.

This judgment establishes a binding legal principle: State authorities cannot engage in, or permit, the unlawful dumping of waste that infringes upon the environmental integrity and fundamental rights of citizens. The authorities in the North are not exempt from this constitutional discipline.

2. The Current Violations in Thunnalai: A Replication of Meethotamulla

Despite the clear warning issued by the Supreme Court today, the Divisional Secretary (DS) for Point Pedro and the Point Pedro Town Council are actively engaged in analogous, if not more egregious, unlawful conduct in the Thunnalai area. Their actions constitute a continuation of state-sponsored environmental degradation that mirrors the very conduct the Supreme Court just condemned.

The specific unlawful acts include the improper disposal, management, and continued operation of waste dumping sites in ecologically sensitive and culturally significant areas, specifically:

· Adjacent to the Thunnalai North Hindu Cemetery: Dumping waste in proximity to a sacred burial ground is not only a public health hazard but a profound violation of the cultural and religious rights of the Hindu community.

· In the Vicinity of the Vallipuram Temple: This area holds immense historical and religious significance. The desecration of its surroundings through waste dumping is an act of cultural vandalism.

· Within the Thunnalai North and Thunnalai East Residential Areas: Waste is being accumulated and managed in a manner that directly exposes residents to toxic leachate, airborne pollutants, and the risk of catastrophic collapse (as seen in Meethotamulla in 2017).

· Farmland Areas: Productive agricultural land, the economic lifeblood of the community, is being polluted and rendered unusable.

This conduct is not mere negligence; it is a deliberate or recklessly indifferent policy that replicates the "unlawful conduct and improper garbage disposal practices" for which the Supreme Court has just held state authorities liable.

3. Legal Basis for Action: Domestic and International Law

Your office is constitutionally obligated to act. The actions of the DS Point Pedro and the Point Pedro Town Council constitute violations under multiple legal frameworks.

A. Sri Lankan Municipal and Environmental Law

· National Environmental Act, No. 47 of 1980 (as amended): The Central Environmental Authority (CEA) has a statutory duty to regulate waste management. The actions of local authorities in Thunnalai are in direct contravention of the CEA’s regulations on scheduled waste management. By failing to obtain proper approvals and implement a compliant disposal system, these authorities are violating Sections 23A to 23Y of the Act.

· Local Authorities (Special Provisions) Act, No. 21 of 1999: The DS and the Town Council have a statutory duty to ensure public health and safety within their jurisdiction. Their current practices constitute a dereliction of this duty.

· Article 12(1) of the Constitution: As established by the Supreme Court today, the discriminatory application of environmental standards—whereby proper waste management is enforced in some areas but flagrantly ignored in Thunnalai—constitutes a violation of the right to equality before the law.

B. International Law (Customary and Treaty-Based)
As a state party to several international instruments, Sri Lanka is bound by the following principles, which your office must uphold:

· International Covenant on Economic, Social and Cultural Rights (ICESCR): Article 11 recognizes the right of everyone to an adequate standard of living, including the continuous improvement of living conditions. The pollution of residential and farmland areas directly violates this right.

· International Covenant on Civil and Political Rights (ICCPR): Article 6 enshrines the inherent right to life. Environmental degradation that poses a risk to life (as established in the Port Hope Environmental Group jurisprudence and echoed by the UN Human Rights Committee) constitutes a violation of this right.

· UN Guiding Principles on Business and Human Rights (UNGPs): While applicable to business, these principles affirm the state’s duty to protect against human rights abuses by third parties, including state actors. The state, through its local authorities, is failing in this duty.

· Stockholm Declaration (1972) & Rio Declaration (1992): Principle 1 of the Stockholm Declaration and Principle 10 of the Rio Declaration establish the foundational principle of a healthy environment for all. The systematic pollution in Thunnalai contravenes these principles of customary international law.

4. Demand for Action

In light of the Supreme Court’s judgment delivered today, the continuation of these practices is not merely an administrative failure; it is an act of defiance against the highest court of the land. The actions of the DS Point Pedro and the Point Pedro Town Council constitute a pattern of conduct that meets the threshold of environmental terrorism—the deliberate destruction of the environment to cause harm to a community.

Therefore, I demand that your office, as the principal legal advisor to the government and the institution responsible for public prosecutions, take the following actions immediately:

1. Direct the Inspector General of Police to instruct the Jaffna Division Senior Superintendent of Police (SSP) to immediately register a criminal complaint (B Report) against the Divisional Secretary (Point Pedro) and the Chairman/Commissioner of the Point Pedro Town Council for:

· Violations of the National Environmental Act.

· Causing a public nuisance under the Penal Code.

· Criminal negligence endangering human life.

2. Instruct the Central Environmental Authority (CEA) to carry out an immediate inspection of the sites in Thunnalai North, Thunnalai East, the cemetery, and the temple vicinity, and to file a report with the Magistrate’s Court, Jaffna, seeking an injunction to halt all illegal dumping activities.

3. Initiate Fundamental Rights Proceedings against the Divisional Secretary and the Point Pedro Town Council, invoking the precedent of Bopage et al. v. CMC et al. (SC FR Application No. [cite if known]/2026), for the violation of Articles 12(1), 14(1)(g) (freedom to engage in any lawful occupation—farming), and the right to life (interpreted to include a healthy environment) under Article 11 of the Constitution.

4. Direct the recovery of civil damages from the officers responsible for the cost of environmental remediation of the affected farmland and residential areas, as the Supreme Court noted in Meethotamulla that compensation had been paid to victims—a principle of accountability that must be applied here.

The community of Thunnalai has endured decades of neglect and systemic discrimination. The authorities in Point Pedro have acted with impunity, treating the Northern citizenry as second-class subjects. The Supreme Court has now spoken clearly: such conduct is illegal, unconstitutional, and will no longer be tolerated.

I await your urgent action on this matter. Failure to act will leave me with no recourse but to seek judicial intervention through the Court of Appeal and the Supreme Court, bringing this matter directly to the judiciary’s attention as a continuation of the Meethotamulla principle.

I implore you to uphold the rule of law without delay.

Your Excellency,

I am Nadarajah Sethurupan, a Norwegian citizen of Sri Lankan origin. I have been a resident of Norway for nearly 20 years and hold a Norwegian phone number that I have used for the same duration. I write to you with deep concern regarding a serious case of identity theft, impersonation, and apparent inaction by the local Sri Lanka police, which compels me to seek your direct intervention.

1. The Crime
Unidentified person have stolen my name and photograph from my page. They have used my name and my photograph on the Viber messaging application, creating a fake profile that impersonates me. This fraudulent profile was then used to communicate with others, and I have also received several missed calls from numbers connected to this impersonation on my Norwegian mobile phone number.

2. My Efforts and Police Inaction
I have written multiple letters to the Sri Lanka police but again reporting this crime and requesting a proper investigation. Despite my repeated complaints, no meaningful action has been taken.

No investigation has been opened, no officer has updated me on progress, and the perpetrator continues to misuse my identity with impunity.

This lack of response leads me to fear that the perpetrator may be acting with the blessing or protection of certain local police elements. Such a situation would not only violate my rights but also damage the integrity of your institution.

3. Request for Investigation
I respectfully request your urgent intervention to ensure a thorough, impartial investigation into the following matters:

· Who is the individual or individuals behind this fake Viber account and the impersonation?

· What was their motive in stealing my identity and using it to deceive others?

· How many persons have been affected or deceived by this impersonation?

· Who is the registered owner of the mobile phone number(s) used to create the fraudulent Viber profile and to make the missed calls to my Norwegian number?

· Why have the local police failed to act on my previous complaints, and is there any truth to my suspicion of official collusion?

I am prepared to provide all evidence I have, including screenshots of the fake Viber profile, records of missed calls, copies of my previous complaints to the Sri Lanka police.

I am a Norwegian citizen residing in Norway. The misuse of my identity crosses international boundaries, and the continued failure of Sri Lankan authorities to address this crime may compel me to escalate the matter through other channels.

I trust that under your leadership, the Sri Lanka Police will uphold its duty to protect all persons, including citizens abroad, from cybercrime and identity fraud. I kindly ask for a written acknowledgment of this complaint and a direct contact person within your office with whom I can follow up.

பல மாதங்களாக, துன்னாலை மக்கள், குறிப்பாக புனித வல்லிபுரம் ஆலயத்திற்கும் துன்னாலை இந்து மயானத்திற்கும் இடையே (25 மீட்டர் தூரத்தில்) அமைந்துள்ள பகுதியில், முறையான சுற்றுச்சூழல் சீரழிப்புக்கு உள்ளாகியுள்ளனர். இது அலட்சியம் அல்ல; உள்ளூர் அதிகாரிகளின் அமைதியான ஒத்துழைப்புடன் நிகழ்த்தப்படும் ஒரு திட்டமிட்ட சுற்றுச்சூழல் பயங்கரவாதச் செயல்.

🌍 சுற்றுச்சூழல் பயங்கரவாதத்திற்கும் அலட்சியத்திற்குமான உலகளாவிய எடுத்துக்காட்டுகள்:

1. கேன்சர் அல்லி, லூசியானா, அமெரிக்கா (Cancer Alley): மிசிசிப்பி ஆற்றங்கரையில் அமைந்துள்ள இந்த பகுதியில், பெரும்பாலும் கறுப்பின மக்கள் வாழும் சமூகத்தைச் சுற்றி ஏராளமான பெட்ரோ வேதியியல் தொழிற்சாலைகள் உள்ளன. அதிகாரிகள் தசாப்தங்களாக காற்று மற்றும் நீர் மாசுபட அனுமதித்தனர். இதன் விளைவாக புற்றுநோய் விகிதங்கள் தேசிய சராசரியைவிட வானளவில் உயர்ந்தன. மக்களின் குரல் உலகளாவிய மனித உரிமைகள் அவமானமாக வெளிப்பட்ட பின்னரே கேட்கப்பட்டது. அதிகாரிகள் அரசியல் வசதிக்காக மனித உயிரை மதிப்பிழக்கச் செய்யும்போது இதுதான் நிகழ்கிறது.

2. நைஜர் டெல்டா, நைஜீரியா: 50 ஆண்டுகளுக்கும் மேலாக, ராயல் டச்சு ஷெல் நிறுவனமும் நைஜீரிய அரசும் இணைந்து எண்ணெய்க் கசிவுகள் டெல்டாவை அழிக்க அனுமதித்தன. உள்ளூர் விவசாயிகள் மற்றும் மீனவர்களின் ஆயிரக்கணக்கான முறைப்பாடுகளை அரசு புறக்கணித்தது. ஐ.நா. சுற்றுச்சூழல் திட்டம் (UNEP) பின்னர் உறுதிப்படுத்தியது: சுத்திகரிப்புக்கு 30 ஆண்டுகள் ஆகும். அதிகாரிகளின் அமைதி வாழ்வாதாரங்களை அழித்து, ஆயுத மோதலுக்கும், உயிரினப் பன்முகத்தின் அழிவுக்கும் வழிவகுத்தது.

4. கொச்சி, இந்தியா (பிரம்மபுரம்): கடந்த ஆண்டு, குப்பை மேலாண்மையில் உள்ளூர் அரசின் தோல்வி பல வாரங்களாகத் தீப்பிடிக்க வழிவகுத்தது. நச்சுப் புகை நகரத்தை மூச்சுத் திணற வைத்தது. குடியிருப்பு பகுதிகளுக்கு அருகிலுள்ள குப்பைக் கிடங்கின் முறைகேடு குறித்து மக்கள் பல ஆண்டுகளாக முறைப்பாடு செய்திருந்தனர். அரசின் அலட்சியம் ஒரு சமூகத்தையே விஷவாயு அறைக்குள் தள்ளியது.

5. கம்புங் பாரு, மலேசியா: 2023 இல், குடியிருப்பு பகுதிகளுக்கு அருகிலுள்ள ஆறுகளில் அபாயகரமான கழிவுகளை சட்டவிரோதமாகக் கொட்டுவது குறித்த முறைப்பாடுகளை அதிகாரிகள் மீண்டும் மீண்டும் புறக்கணித்தனர். அரசு செயல்படத் தவறும்போது, சட்டவிரோதக் கும்பல்கள் சமூக நிலங்களைத் தங்கள் சொந்தக் குப்பைத் தொட்டிகளாகப் பயன்படுத்த ஊக்குவிக்கப்படுகின்றன. இதன் விளைவாக பாரிய நஞ்சூட்டலும், மில்லியன் கணக்கானோருக்குக் குடிநீர் விநியோகம் நிறுத்தமும் ஏற்பட்டன.

6. பசிபிக் தீவுகள் (காலநிலை அலட்சியம்): குப்பை கொட்டுவது மட்டுமல்ல; துவாலு, கிரிபதி போன்ற பசிபிக் தீவு நாடுகளின் வேண்டுகோள்களைப் புறக்கணித்து ஆஸ்திரேலிய அரசு காலநிலை மாற்றத்தில் வரலாற்று ரீதியாக எடுத்த செயல்பாட்டின்மையும் ஒரு வகை சுற்றுச்சூழல் பயங்கரவாதமாகும். அதிகாரிகள் இந்தச் சமூகங்களின் இருப்புக்கு எதிரான அச்சுறுத்தலைப் புறக்கணித்ததன் மூலம், முழு கலாச்சாரங்களையும் கடலில் மூழ்கும் நிலைக்குத் தள்ளினர்.

🚨 URGENT: ENVIRONMENTAL TERRORISM IN THUNNALAI – A CALL FOR GLOBAL ACCOUNTABILITY 🚨

For months, the residents of Thunnalai, particularly in the area between the sacred Vallipuram Temple and the Thunnalai Rural Hindu Cemetery (a stretch of barely 25 meters), have been subjected to systematic environmental degradation. This is not negligence; it is a calculated act of environmental terrorism being perpetrated with the silent complicity of local authorities.

Despite a formal complaint lodged by Mr. Nadarajah Sethurupan, a concerned resident of our village, to the Jaffna Government Agent (GA), the Point Pedro Urban Council (UC), and the Point Pedro Town Council (TC), there has been absolutely no response. The silence from the Tamil government officials who are sworn to protect our land speaks louder than the waste that is choking our sacred spaces.

When officials ignore the poisoning of our soil, water, and air, they are not merely failing at their jobs—they are actively participating in the destruction of our community. This is environmental terrorism.

This is not a local issue; it is a global crime.

Around the world, we have seen how the failure of state actors to protect the environment leads to the destruction of communities. The world has witnessed these atrocities, and we refuse to be silent while they happen here.

🌍 GLOBAL EXAMPLES OF ENVIRONMENTAL TERRORISM & NEGLIGENCE:

1. The Cancer Valley, Louisiana, USA (Cancer Alley): Stretching along the Mississippi River, this predominantly Black community is surrounded by petrochemical plants. State officials allowed corporations to pollute the air and water for decades, resulting in cancer rates that are astronomically higher than the national average. The residents’ cries for help were ignored until it became a global human rights scandal. This is what happens when authorities value political convenience over human life.

2. The Niger Delta, Nigeria: For over 50 years, Royal Dutch Shell and the Nigerian government colluded to allow oil spills that devastated the Delta. Despite thousands of complaints from local farmers and fishermen, the government ignored the destruction of mangroves and farmlands. The UN Environment Programme (UNEP) later confirmed that the cleanup would take 30 years. The silence of the officials led to the loss of livelihoods, armed conflict, and the extinction of local biodiversity.

3. Bhopal, India (1984 & Aftermath): While the initial gas leak was a corporate disaster, the environmental terrorism began afterward. The state government failed to remove 350 tonnes of toxic waste from the abandoned Union Carbide plant for nearly 40 years. Officials ignored the community’s demands for clean drinking water and soil remediation, allowing generations to be born with severe birth defects. Inaction by the state is a slow-acting poison.

4. Cochin, India (Brahmapuram): Just last year, the failure of local government to manage a massive waste yard led to a weeks-long fire. The toxic smoke blanketed the city. Residents filed complaints for years about the mismanagement of the dump yard located near residential areas. The government’s negligence turned a community into a gas chamber.

5. Kampung Baru, Malaysia: In 2023, authorities repeatedly ignored complaints about illegal dumping of hazardous waste into rivers near residential areas. When the state fails to act, it encourages illegal syndicates to treat community lands as their personal dumping grounds, leading to mass poisoning events and the closure of water supplies for millions.

6. The Pacific Islands (Climate Negligence): While not dumping, the Australian government’s historical refusal to act on climate change—despite pleas from Pacific Island nations like Tuvalu and Kiribati—is a form of environmental terrorism. By ignoring the existential threat to these communities, state actors condemned entire cultures to drowning.

WHY THIS MATTERS FOR THUNNALAI:

When officials ignore the waste accumulating between a Hindu Temple (a place of worship) and a Cemetery (the final resting place of our ancestors), they are attacking the spiritual and physical health of our people.

· Public Health: Unmanaged waste breeds dengue, contaminates groundwater, and releases carcinogens into the air.

· Intergenerational Trauma: When we allow this to happen without consequence, we teach our children that their lives and their sacred land are worthless in the eyes of the government.

· Ecocide: This is a crime against the environment that destroys the ability of the land to sustain life.

OUR DEMAND:

To the Jaffna GA, Point Pedro UC, and Point Pedro TC:

Your silence is consent. You have received the complaint. If you do not act, you are accomplices to this environmental terrorism.

We demand:

1. Immediate removal of all waste from the Thunnalai area, specifically between Vallipuram Temple and the Thunnalai Hindu Cemetery.

2. Permanent accountability for the officials who have allowed this to fester.

3. A public inquiry into why the complaints of Mr. Nadarajah Sethurupan and the people of Thunnalai were ignored while our health was being jeopardized.

We will not be silenced. We will not let our homeland become a dumping ground.
