You will find below an example of a letter canceling an agreement.
You can use this letter as a template If you have any doubt whether an agreement you have concluded is based on errors, misuse of circumstances, or deceit.

Article 228 of Dutch Civil Code Book 6 gives a party the right to nulify any agreement based on errors, misuse of circumstances or deceit.

Dear readers,

Here are 6 tips which you can use/implement in the drafting of your privacy policy. According to Article 5 of the GDPR, a company must follow a series of principles meant to process and secure personal information. A risk-based approach ensures adherence to such principles.

A business must comply with the GDPR, if its:
-processes or collects information from citizens in the European Union. It does not matter where the business is located.
-More than 250 employees.

*A business with fewer than 250 employees must also be GDPR compliant if there data-processing occasionally impacts the rights and freedoms of data subjects, or includes certain types of sensitive personal data.

Once this is established, it is up to the company to appoint or identify a data controller, processor and Data Protection Officer (DPO) to oversee data security strategy and GDPR compliance.

More on how and why companies must appoint a DPO will be revealed in later posts.

Voorbeeld verhaal:

Tom verzamelt al enkele jaren special editions van Johnny Walker. Hij heeft ze allemaal in een vitrine kast neergezet, zodat ze beschermd worden. Op een avond is hij aan het werk en zijn broertje, piet is alleen thuis met een aantal vrienden. Hun ouders zijn al 2 weken op vakantie en het boodschappen doen schiet er een beetje in. Piet besluit dat het drinken van een fles whisky van Tom kwel voor enige gezelligheid zal zorgen. Hij ziet vier flessen van dezelfde soort staan en verwacht dat het niet zal opvallen als hij er een van aanbreekt. Als Tom thuis komt en de ontbrekende fles whisky ziet, is hij woedend. Hij had een overeenkomst gesloten met een whisky handelaar die de complete collectie wilde overnemen voor €8.000,-. Als de collectie niet compleet is, zal Tom maar €850,- per fles ontvangen. De handelaar had op de collectie gerekend en had het geld van €8.000,- al overgemaakt. Aangezien Tom de overeenkomst niet meer kan nakomen, vordert de handelaar €8.000,- en daarbovenop een schadevergoeding.
