Trong một số trường hợp, có thể áp dụng luật EU. Các lợi thế chính bao gồm:
• không cần xin MVV (không phải thi A1);
• có thể chờ kết quả hồ sơ tại Hà Lan;
• không có nghĩa vụ hội nhập.

• geen mvv vereist (dus geen A1-examen);
• de beslissing op de verblijfsaanvraag mag in Nederland worden afgewacht;

Điều 2r, khoản 1 Luật Người nước ngoài 2000:
Nếu giấy phép lưu trú tạm thời (MVV) đã được cấp, bạn phải lấy tem MVV tại Đại sứ quán hoặc Lãnh sự quán Hà Lan trong vòng 3 tháng.
Lưu ý: Nếu không lấy đúng thời hạn, MVV sẽ hết hiệu lực và bạn phải nộp hồ sơ xin MVV lại từ đầu.

Dưới đây là một trường hợp HN Legal đã hỗ trợ khách hàng thay đổi địa điểm dán tem MVV, do lịch hẹn tại Đại sứ quán Hà Lan nơi khách hàng đang sinh sống đã kín và không thể đặt hẹn trong thời hạn 3 tháng theo quy định.

Artikel 2r, lid 1 Vreemdelingenwet 2000:
Als een machtiging tot voorlopig verblijf (MVV) is toegekend, moet de MVV-sticker binnen 3 maanden worden opgehaald bij de Nederlandse ambassade of het consulaat.
Let op: Als u de MVV niet op tijd ophaalt, dan vervalt de MVV en moet u opnieuw een MVV-aanvraag indienen.

Hieronder volgt een geval waarin HN Legal een klant heeft geholpen bij het wijzigen van de locatie voor het plaatsen van de MVV-sticker, omdat de afspraken bij de Nederlandse ambassade in het land waar de klant woont volledig volgeboekt waren en er binnen de vereiste termijn van 3 maanden geen afspraak beschikbaar was.

Article 2r, paragraph 1 of the Aliens Act 2000:
If a provisional residence permit (MVV) has been granted, the MVV sticker must be collected at the Dutch embassy or consulate within 3 months.
Please note: If you do not collect the MVV in time, the MVV will expire and you will have to submit a new MVV application.

Below is a case in which HN Legal assisted a client in changing the location for collecting the MVV sticker, as appointment slots at the Dutch embassy in the country where the client resides were fully booked and no appointment was available within the required 3-month period.

Mặc dù việc nộp các bằng chứng về mối quan hệ (như hình ảnh) không bắt buộc đối với hồ sơ xin MVV cho khách hàng đã đăng ký kết hôn với người bảo lãnh, nhưng theo kinh nghiệm thực tế, việc gửi kèm những bằng chứng này có thể giúp hồ sơ được duyệt nhanh hơn.

Hoewel het overleggen van bewijsstukken van de relatie (zoals foto’s) niet verplicht is bij een MVV-aanvraag voor klanten die gehuwd zijn met de referent, kan het volgens onze ervaring helpen om de beoordeling van de aanvraag te versnellen wanneer dergelijke bewijsstukken worden meegestuurd.

Although submitting evidence of the relationship (such as photos) is not mandatory for an MVV application for clients who are legally married to the sponsor, our experience shows that including such evidence may help speed up the processing of the application.

Cơ quan Di trú và Nhập tịch Hà Lan (IND) gần đây đã tăng cường kiểm tra nghiêm ngặt đối với quyền giám hộ của cha mẹ. Vì lý do này, mẫu đơn xin MVV dành cho trẻ em đi cùng cũng đã được điều chỉnh.

De Immigratie- en Naturalisatiedienst (IND) hanteert de laatste tijd strengere controles op het ouderlijk gezag. In verband hiermee is het MVV-aanvraagformulier voor meereizende kinderen aangepast.

The Immigration and Naturalisation Service (IND) has recently implemented stricter checks regarding parental authority. As a result, the MVV application form for accompanying children has been revised.

Hôm nay, HN Legal tiếp nhận một trường hợp khách hàng bị IND từ chối hồ sơ và cần hỗ trợ khiếu nại. Khách hàng trước đó đã nộp hồ sơ qua công ty Halcyon Legal & Finance, do hiểu nhầm rằng công ty này làm việc cùng HN Legal.

Đây không phải là lần đầu xảy ra sự nhầm lẫn tương tự. Vì vậy, HN Legal xin đính chính rõ ràng rằng chúng tôi không có bất kỳ liên kết hay hợp tác nào với Halcyon Legal & Finance, nhằm tránh những hiểu lầm đáng tiếc trong tương lai.
