The decision of Cubana Chief Priest to plead not guilty to the charge of mutilating the Naira is a very smart one. Some may argue that there is a video footage showing him committing the offence, as such he cannot escape from conviction. But we must bear in mind that a video footage is a form of electronic evidence that must meet the strict requirements of Section 84 of the Evidence Act.
The case hangs on the admissibility of this piece of evidence. If the video footage is held inadmissible, the case is very likely to fail. Even if he is convicted for the offence, he cannot be sentenced to imprisonment beyond the six months given to Bobrisky who pleaded guilty.
I owe Cubana Chief Priest a bottle for this smart plea.
