Debt plays a crucial role in commercial practices by facilitating business growth, enabling trade, and supporting cash flow management. It allows companies to access capital without immediately depleting their resources, which can be used for expansion, inventory purchases, or bridging payment gaps. Through structured credit arrangements, businesses can operate efficiently even when immediate funds are not available. Moreover, debt serves as a tool for fostering trust and long-term relationships between trading partners, where goods and services are provided with the expectation of future payments.

Despite its benefits, the recovery of debt can be challenging for creditors. Debtors may delay or default on repayment due to financial constraints, disputes, or deliberate avoidance. In jurisdictions like Nigeria, recovery can be further complicated by lengthy court processes, lack of proper documentation, and weak enforcement mechanisms. These obstacles often leave creditors struggling to recover their funds efficiently, underscoring the importance of clear contractual terms and proactive legal strategies.

In our latest article, we broke down the debt recovery process in Nigeria, your rights under the law, and practical steps you can take to reclaim your funds — whether you're an individual, a business, or a financial institution.

Today, April 28, 2025 the Magistrate Court of Rivers State, sitting at Rumuodomaya delivered a ruling in our favour in Suit No. RMC/SSC/19/2024, Chika Chukwuka (Suing Through her lawful Attorney Thankgod Orji Consulting ) vs. Mr. Itekena Altraide Zephaniah where the suit of the Claimant against our Client (the Defendant) was dismissed.

We opposed the suit on the grounds that Thankgod Orji Consulting is not a juristic person, therefore it cannot be a donee of a power to sue, neither can it maintain an action on behalf of legal person.

We further opposed the suit on the ground that the purported power of attorney did not expressly donate the power to sue to the purported donee. We contended that a power of attorney is strictly construed. The purported donee cannot assume powers not expressly donated to it, especially when the legal rights and obligations of third parties may be affected by the exercise of such power, like in this case.

Lastly, we opposed the suit on the ground that the purported power of attorney lacked attestation by a notary public, or any person having the powers to so attest to it's due ex*****on; and in the absence of evidence of it's due ex*****on, we asked the court to declare same invalid and incapable of forming the basis on which the purported donee could maintain the action on behalf of the purported donor against our client.

The court agreed with us on all the grounds and issues raised.

The suit was accordingly dismissed.

Our team was led by Nnadum Nso Obulor with Ubi Prince Benson.
