The *Supreme Court* in the recent case of F.R.N. v. Kanu held inter alia as follows:
*The African Charter on Human and Peoples Rights Cap. 10 LFN 2024 and other statutes of International flavour will prevail if there is a conflict between it and another statute. This is because it is presumed that the legislature does not intend to breach an international obligation. But that is not to say that the Charter is superior to the Constitution nor can its International flavour prevent the National Assembly from removing it from our body of municipal laws by simply repealing it.*
