7 Blunders Every Artiste Must Not Make In 2017! πŸ‘ˆ

2016 had more than its fair share of artistes fighting with their record labels, being arrested and detained by the police and getting dragged to court by show organizers, promoters and investors. We advise every artiste to avoid making the following mistakes in 2017 so their careers can move forward without unnecessary drama:

1. Being too desperate to sign a contract (I-Must-Blow-Syndrome). 😟

It funny how the same artistes who eagerly jumped at a recording/Management deal without properly understanding the terms turn around to complain that they have been enslaved by their management or record label. Pls take your time to go through the terms of the contract with your lawyer and think it through before signing.. Ranting on social media will not epp you in 2017.

2. Begging people upandan to sponsor your career without having anything to bring to the table. 😏

You dont have a certified hit..Your fan base is next to zero and your rap/vocal skill level is below average..Haba, Music is not a ponzi scheme, na.. Pls repent in 2017

3. Refusing to learn how the music business works (Especially Christian Artistes) πŸ™…

Just living in a bubble and assuming you will blow when it is your time without learning about the music business will not epp you in 2017. Berra humble yourself and learn as much as you can about the music business. Even the bible tells us to go learn from the ant and study her ways.

4. Signing a cut and paste record contract your label/management found on the internet. πŸ˜’

So in order to avoid paying lawyer fees, you decide to sign a contract you downloaded online without asking yourself if it fits your particular arrangement. You just copied and pasted and signed! Clap for yourself! Issorai.. Kontinu.. When it all goes south for you in 2017, you go know say na only u waka come.

5. Not bothering to research the background of a label or investor. 😦

So you have been offered a mouth-watering deal with a house in lekki and Range Rover Sport and you are ready to sign your life over without even finding out what you can about your so-called "helper of destiny" and whether they are capable of delivering on what they are promising.. Hmmm, may ur career not be on life-support in 2017.

6.Getting free Car and free apartment in Lekki from your investor/Label without expecting them to collect it back with interest πŸŽ…

My dear, by now you should know that a record label is not "Father Christmas" so whatever money or 'gift' is being offered to you as an advance will be recouped with interest from the income you generate as an artiste.

So ask yourself 'Do you really need to start doing 'Big Boy/Big Babe' on credit while your label is making the real profit from your sweat?

7. Refusing To Hire an Entertainment lawyer.😏

*Sigh* I could say this a hundred times but some of you think the cost of hiring a good entertainment lawyer is much more expensive than not having one. Well, i hope 2016 has taught you better.. If not, be comforted that you are going into 2017 with no legal protection whatsoever. You are like a man going into sambisa forest in his birthday suit. I hope your 'Rambo Skills' are adequate to see you through. Have a great year!

7 THINGS TO LOOK OUT FOR IN A RECORD DEAL! 😟

1.What type of deal is it?
Is it a licence or outright assignment of your commercial rights to the recordings. Is it strictly about record sales or a 360 deal? 😐

2.For how long?
You absolutely must know the number of years the contract will last and what options are available to you at its expiration. The shorter the term the better for the artiste 😁

3. How many albums?
It is vital to know how many albums you are expected to record within the duration. Sometimes it is possible to negotiate guaranteed releases on the first two or even three albums. It is in the artist’s interest to have as few options in the agreement as possible. 😌

4. Who covers the expenses?
Never assume the record label will pay for studio sessions,video shoots and promotion. Make sure its spelt out clearly and that there's a timetable for these activities or you might be sitting on a very looooong thing! πŸ˜“

5. What is the sharing formular?
Don't be bamboozled by the free car, free accommodation and advance you are been offered. It will all be recouped from the money the label makes off you. Insist on knowing the royalty rates payable by the Record Label for physical record sales as well as digital downloads, ringback tunes and real tones and for sales as a result of streaming. Also the rates for master re-uses where a recording is synchronised with visual images in a film, TV programme or an advertisement.πŸ˜‡

6.Who has Artistic Control?

If you have certain convictions about your music that might clash with the commercial mindset of the record label,its vital to know the uses of the recordings for which the Record Label needs approval from the artist and also whether or not a recording delivered by the artiste can be rejected as technically or
commercially unacceptable by the Record Label. Also as to whether or not the Record Label or the artist has the final approval over artwork, biographies, photographs and videos etc. 😊

7. What's your escape plan?
This is the most important of all. You must know what your options are if things fall apart. You dont want to be trapped in a record deal with your career on life support while you are ranting away on twitter when a well-defined termination clause would have freed you from slavery..lol. READ THE TERMINATION CLAUSE AND UNDERSTAND IT WELL BEFORE YOU SIGN! Shikena! 😎

THIS IS WAR! ARTISTES VS LABELS!!

Its a proven fact that 80% of Nigerian Artistes end up fighting with the Record Labels they sign on with. And out of this number, barely 10% survive the battle with their careers still intact.

More saddening is the fact that most artistes who feel cheated in this arrangement would rather take to the court of public opinion in order to whip up sentiments for their cause rather than seek legal means of redress. However, twitter rants and IG posts do not win court cases..Lawyers do!

So we have labels dragging reluctant artistes to court and getting their pound of flesh in the millions leaving their erstwhile signees with broken hearts and ruined careers. I guess, its safe to say "Houston, we have a problem!"

So lets get to the root of the matter! A quick survey of the controversial cases involving labels and artistes in recent times like Chocolate City Vs Brymo, YSG Vs Vector, EricManny Entertainment Vs Runtown and now Baseline Records Vs Skales, reveal that the root of the matter is a matter of the root i. e the contract itself.

What did both parties agree? Who gets what percentage out of which money? Who pays for what expenses and within what period of time must the payment be made? What happens when either party fails to perform or wants out of the contract?

Its high time, Nigerian Artistes realized that engaging the services of an entertainment lawyer is a necessity and not an option. Getting wise counsel from seasoned entertainment professionals will save you a lot of trouble and heartache later on. Remember, Fans dont win legal battles..Lawyers do. Get one today!

DEAR RECORD LABEL, WHERE IS MY MONEY?

So your album sold over a million copies, yet your paycheck hardly reflects your celebrity status..You sense foul play and start ranting on social media.

Before you start a full scale war with your record label, you should read some more..

The purpose of signing with a label is of course to record and sell music. Here’s what you can expect as a breakdown of percentages of Mechanical royalties from music sales:

CD SALES

CD - In the making of a CD, here are the key players and the percentage of sales that they should get:

Artist (6.6%)
Producer (2.2%)
Songwriters (4.5%)
Distributor (22%)
Manufacturing (5%)
Retailer (30%)
Record label (30%).

DIGITAL SALES

ITunes - Selling an album on iTunes has less key players and the percentages are split a bit differently, though the artist doesn’t see much more at the end of the day. Apple takes 30%, and the label collects the remaining 70%, of which they pay out about 12% of their end to the artist (about 8% of the total purchase price of the album).

Other Digital Stores - It depends on their individual rates..but they do get a healthy chunk and the label does too..

OTHER STREAMS OF INCOME

For other streams of income accruing from your music, the sharing formular stated in your contract would determine your share especially if you signed a 360 deal with the recording company.
