Here are some simple but powerful ways you can detect a fake real estate company in Lagos:

Legal registration

Before using a real estate company for your real estate investment, you need to carry out a thorough research on the company to find out

if the company is duly registered with Nigeria CAC (Corporate Affairs Commission).

If you find out that the company is registered, you need to check if they have the license to operate as a Real Estate company.

Some of the bodies responsible for giving out license to Real Estate companies include

Real Estate Developers Association of Nigeria (REDAN), Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON), among others..

Document verification and authentication

There are also a lot of required documents to be ascertained and verified before you proceed to make payment.

Bank Account Details:

The account details of the real estate company must bear the official name of the real estate company.

And. If the one they give is not an official account, it's a red flag

Payment plan not detailed.

If you did not see any detailed payment plan on the application form, it's a red flag

Communication

All related communications must be conveyed through the company’s registered communication points.

Ensure that your email communication is being conveyed through the company/brand name.

Standard office

Most fake real estate company do not have a standard and conducive office.

Ensure that you engage most of your related communications in the company’s office.

Avoid meeting with an agent in a restaurant and fun places

Inspection must be carried out by the real estate company Vehicles

Ensure you go to the real estate companies office and from their you proceed to the site for inspection.

Never go by yourself for inspection or with an agent.

In this article, I will discuss how buyers can prevent themselves from becoming victims of land-related frauds.

Get a boundary wall constructed:

This should be the first thing to do, so aas to prevent any story that will not have a happy ending
An unattended open and unprotected land bring attention of the land grabbers popularly called "Omo nile". To keep them far off, simply construct a boundary wall. Then a sign on the gate or wall indicating the real owners

Make sure you have all the necessary documents:

Document of the land, will proof the owner of the land. All necessary documents should be paid for promptly. Ensure you have all this ready

Keep a caretaker inside

Try as much as possible to get hired hands to be leaving on the land. And also, make unannounced visits to the land. And also, ask your friends and relatives to do this for you, These visits would give the neighbours an idea about the real owner.

Seek your neighbour’s help:

If the plot is in an already inhabited area, become friends with your neighbours and request them to monitor your land— even if you have hired a caretaker. Informal as it is, this is quite an effective strategy to keep your immovable asset safe

Be quick to report

Location, location, location" is a common mantra in real estate.

Take it or leave it, this is a quality advice but the sad part is

I remember Adagoke, a banker with one of the new generation banks.

Fews months ago, was in need of a land he could build her home.

So we talked, went for inspection

while we breezed through the Dangote Refinery in Ibeju-Lekki, he was amazed

*A Gazette* is an Official record book where all special government details are spelt out, detailed & recorded.

A *gazette* will show the communities or villages that have been granted *excision* and the number of acres or hectares of land that the government has given to them.
It is within those *excised* acres or hectares that the traditional family is entitled to sell its lands to the public & not anything outside those hectares of land given or *excised* to them.

*Question:* Is excision as good as obtaining c of o?
Is a person having excision still mandated to obtain c of o?

*Answer:* After a land has been excised & Gazetted, then you can either process your C of O or Governor consent.

*Excision* does not expire while C of O expire after 99 years.
The only advantage C of O has over Excision is that, it can be use as collateral for getting loan in the bank

*DEED OF CONVEYANCE*

*Deed of Conveyance* or Registered Conveyance was the authentic evidence of ownership until 1978 Land use Act that introduced Certificate of Occupancy.

Deed of Conveyance is old legal document used in transferring the interest of the owner of a landed property interest to the person to another whom it is assigned, the assignee.
When ownership is transferred, the new legal document in use now is called deed of assignment.

*CERTIFICATE OF OCCUPANCY*

A Certificate of Occupancy (C of O) issued by the Lagos State Government officially leased Lagos land to you, the applicant, for 99 yrs.
*All lands belong to the Government.*

*GOVERNOR'S CONSENT*

A governor’s consent can only be processed on a land with either Gazette or an Existing Certificate of Occupancy (C of O).

If a person with land with C of O decides to sell his land, the only documents that can give the new buyer or every other subsequent buyers the right of occupancy or ownership is a governor’s consent.
The powers of the Governor to consent to such transactions can be found in Section 22 of the Land Use Act of 1978 which states thus:
*'It shall not be lawful for the holder of a statutory right of occupancy granted by the governor to alienate his right of occupancy or any part thereof by assignment, mortgage, transfer of possession, sublease or otherwise howsoever without the consent of the Governor first had and obtained''*
This simply means therefore that even when a buyer has secured a land with a Certificate of Occupancy, he shouldn't stop there.
He needs to begin the process of obtaining a Governor's consent to make that purchase legal in the eyes of the government & be rest assured his land is safe.

*DEED OF ASSIGNMENTS*

Most people have the title documents to their cars intact & in safe places but fail to ask for the Deed of assignment to their properties which is several times more valuable than cars

*A Deed of assignment* is one of the transactional document drawn up by a real estate attorney between the current title holder for a particular property & the new buyer.

In real property transactions, a deed of assignment is a legal document that transfers the interest of the owner of that interest to the person to whom it is assigned, *the assignee.*
When ownership is transferred, the deed of assignment shows the new legal owner of the property.

The deed contains very pertinent information for a real estate transaction. It spells out the date when the ownership of the property transfers from one owner to the other.
The deed also gives a specific description of the property that is included in the transfer of ownership.

It is very compulsory & mandatory for a Deed of Assignment document to be recorded at the appropriate land registry to show legal evidence as to the exchange of ownership in any land/landed property transaction in order to make the general public and government aware of such exchange or transaction.

UNDERSTANDING HOUSING UNITS.

I have over the time realized that many people, especially "would-be” investors in home and housing properties, are confused or do not really understand certain terms and terminologies in this type of real estate. And this confusion often affect their purchasing or investment decisions. Some do not even know that, FLAT and APARTMENT are different words that carry the same meaning. For instance, if I say, “2 bedroom apartment”. And also say, “2 bedroom flat". I'm referring to the same thing. The only difference here is, while “FLAT" is British English usage. APARTMENT is North American English usage.

It is on this premise, I have taken it upon myself to educate and enlighten you, my lovely friends and fans, on a few Terminologies associated with buying a House or Housing Units.

1. EN-SUITE
This is simply an apartment or house where all the bedrooms has its own toilet and bathroom.

2. DETACHED
E.g. A detached Duplex. This is a stand alone duplex in a compound.

3. SEMI-DETACHED
E.g. A semidetached Duplex. This is a twin duplex but the duplex are seperated by a fence.( i.e is a house that is joined to another house on one side by a shared wall).

4. TERRACE
This comes in form of multiple apartments in the same compound.

5. BUNGALOW
A Bungalow is a stand alone flat. It could be 1 bedroom bungalow, 2 bedroom bungalow, 3 bedroom bungalow...
