What could the proposed amendments to Nigeria’s oil spill regulatory framework mean for businesses in the petroleum sector?

The National Oil Spill Detection and Response Agency (Establishment) Act (Amendment) Bill, 2025 proposes significant changes to NOSDRA’s regulatory and enforcement powers, including higher penalties for non-compliance, new remediation requirements, expanded oversight of decommissioning activities, enhanced inspection powers and proposed prosecutorial authority. But beyond stronger enforcement, the Bill raises important questions around criminal liability for oil spills, compensation, regulatory overlap between NOSDRA, NUPRC and NMDPRA, and the potential compliance implications for operators.
