Some procedural mistakes in criminal cases must be avoided at all cost. The court of first instance should always avoid omissions that will affect the final decision of the court. We have read the case of Ibrahim v. State (2025) LPELR-81329(SC) and found this omission very disturbing. The Supreme Court held that where a criminal charge is amended after the accused has already taken his plea, a fresh plea shall be taken before the continuation of the hearing of the case. The court of first instance failed to call on the Appellant in this case to take his plea after the charge was amended. Upon appeal, the Court of Appeal ordered for a re-trial. Now the High Court will have to go through the same process again.

Where the right thing is done at the Trial Court, a lot of expenses and time will be saved for both the state and the parties.

We have read the recent Judgment of the Supreme Court of Nigeria in the case of Ndubuisi v. Shobande (2025) LPELR-8127(SC) and all I can comment is that failure to adhere to a simple procedure can make a party to lose a case that would have ordinarily been in his/her favour. You need to be right both on the subject and procedurally.

Under the Nigerian law, a court hearing a petition for a decree of dissolution of marriage shall hold the marriage to have broken down irretrievably if the Petitioner proves or satisfies the Court that since the marriage, the Respondent has behaved in such a way that the Petitioner cannot reasonably be expected to live with the Respondent.
