Protecting the Root of Title: Observations on Inherited Property and Due Diligence

During a recent professional site visit for a property inspection, I was reminded of the significant legal complexities inherent in Succession Planning and the preservation of multi-generational wealth within the Nigerian real estate sector.

The property in question was an inherited asset a testament to the foresight of a previous generation. However, the transition of ownership from one generation to the next is rarely a simple matter of possession; it is a matter of strict legal compliance.

Legal Observations on Property Inspections & Inherited Assets

For the diligent investor or beneficiary, a physical inspection coupled with comprehensive due diligence serves three critical legal functions:

1. Verification of Physical Boundaries: Over decades, physical markers (beacons) can be altered or obscured. An inspection ensures the survey plan accurately reflects the ground truth, preventing future boundary disputes.
2. Identification of "Root of Title":In cases of inheritance, it is essential to trace the legal authority of the transferor. Without a valid Letter of Administration or a Grant of Probate, any subsequent transaction on the property may be considered void ab initio.
3. Risk Mitigation against Encroachment: Regular professional oversight prevents adverse possession claims and ensures that the asset remains secure for the intended beneficiaries.

The Bulletproof Framework: How I Protect My Diaspora Clients From Land Scams

Every week, I get the same DM from Nigerians in the UK, US, Canada, and beyond:
"Barrister, how can I be 100% sure this land won't be a problem in 5 years?"

The answer isn't trust. The answer is a Rigorous Legal Process. When you are sending your hard-earned foreign currency home, you cannot afford to assume anything. Here is the exact, step-by-step Due Diligence framework I use at Lyn Opurum Legal to ensure our clients never lose a kobo:

✅ The Title Document Audit
We don't just look at the paper; we verify its root. Whether it’s a Certificate of Occupancy (C of O), a Governor’s Consent, or an Excision, we analyze the authenticity before the deal moves forward.

✅ The Land Registry Search
We go directly to the Government Land Registry (e.g., Alausa for Lagos properties). We check for Encumbrances :is the land tied up in a bank loan? Is there a pending court case? If it's not clean in the registry, it's not a deal.

✅ Survey Plan Verification 📍
This is where many go wrong. We take the coordinates from the Survey Plan and cross-check them with the Surveyor General’s Office. We must confirm the land is Free and not under Government Acquisition (earmarked for future public projects).

✅ Family & Community Background Checks
For Family Land, we go beyond the paperwork. We verify that the persons signing the "Deed of Assignment" are the legitimate representatives of the family. This because a sale without proper family consent is a lawsuit waiting to happen.

✅ Physical Inspection & Boundary Check
We don't just look at photos on WhatsApp. We conduct a physical site visit to ensure the land actually exists, matches the dimensions on the paper, and isn't being encroached upon by neighbors.

⚠️ A Critical Warning for the Diaspora

A few months ago, precisely in November 2025,a mother walked into the FIDA Nigeria Epe legal clinic one Wednesday morning completely broken. International Women's Day Celebration Message

Today we celebrate the strength, courage, resilience, and brilliance of women across the world.

Happy International Women's Day to every phenomenal woman especially Nigerian women who continue to rise, lead, build, nurture families, and create opportunities against all odds.

But today is not just about celebration.

It is also about ownership, dignity, and economic power.

For many years, women were often excluded from conversations about land, inheritance, and property ownership.

Many girls grew up hearing things like:

“Your brothers will inherit the property.”
“Your husband will provide.”
“Property matters are for men.”

But the truth is this:

A woman has the right to own property, inherit property, acquire land, and build wealth.
