RE: MEL OBI - A FRAUDSTER OF FACEBOOK

I am the Proprietor of OTAYEMI LAW OFFICE. A client just called my attention to a Facebook Account that runs by the name of Mel Obi who describes himself as a “Lawyer”.

It should be clear to all that the page is hosted by a Fraudster. His academic history has nothing to show that he attended the Nigerian Law School where Lawyers are made, accredited and called to the Nigerian Bar.

It is impossible to be an Associate in a Law Firm without being called to the Nigerian Bar.

Mel Obi or whatever his true identity is, is an impostor and a fraud.

We do not know him at OTAYEMI LAW OFFICE and he has no relationship with us.

EVIDENCE - EVIDENCE OF AN EYE WITNESS - Whether the evidence of an eye witness is conclusive in a charge of armed robbery where the accused has raised the defence of alibi

“It was wrong for the trial Court to dispense with the plea of alibi to convict the appellant on the ground that the defence of alibi does not arise where there is an eye witness. That "the defence of alibi does not arise where there is an eye witness" is not a correct statement of the law. The evidence of an eye witness is not conclusive. The evidence has to be considered in the light of Police investigation of the plea of the accused as the eye witness may be mistaken in his identification of the accused." “The jurisprudence behind the above opinion in my humble view is that a party should not be allowed to get away with changing his story as the case proceeds. A process that is struck out has no more teeth and cannot be used by the party or adverse party as a general rule. However, it is still part of the process in the file. It cannot be wished away. The Court and the party who filed the struck out or amended process cannot use it to urge the case of the party; however the adverse party can use it to discredit the witness or the evidence of the party who filed it. It would amount to lack of fair hearing in our adversarial system of jurisprudence if the contradictory evidence already stated in writing which has been struck out cannot be allowed to be used to cross examine the witness who gave contradictory evidence.” Per Ogunwumiju, JCA.

Today May 13, 2019, the Chief Judge of Ondo State delivered a landmark judgement in HOR/2/2004.

In a judgement that is as historic as it is far reaching, His Lordship found in favour of Ikales against Araromi Obu community.

His Lordship found that Araromi Obu people are living within Ikale territory and confirmed that they were settled on the land at Ode Obu and Araromi Obu by Ikales.

His Lordship held that they can continue to occupy Araromi Obu but restrained them from further trespassing on any part of the land outside Araromi Obu.

The Araromi Obu community sued Ikales to court seeking to expel them from their land under the pretext that they have no land in Odigbo LGA. Their case was dismissed while the Counterclaim of the Ikales succeeded.

We give thanks to Almighty God and we give him all the Glory for permitting us to be part of this historic decision.

I appreciate O. B. Tobase Esq. and other members of the legal team who had a hand in todays victory.

Specifically, I recognise the efforts of Lawyer Adeyanju, Adejumo Adetona and Jonathan Arome Agbo. They are wonderful people.

I congratulate the Abodi of Ikale land and all other Ikale Obas for this victory which we pray will be a harbinger of more victories over almost lost territories!

Yesterday, October 2nd 2018, a very cerebral, man-of-his-court and quintessential judge of the Ondo State High Court sitting in High Court One, Ondo - Justice Bode Adegbehingbe - gave me a belated birthday gift and had me walking on the clouds all day long.

In a case involving almost all Ikale Royalties with the former Attorney General of Ondo State - R. Peter Olatubora on the other side, His Lordship dropped his pen at a stage and said that in his 16 years on the Bench, this is the best conducted case he has ever handled and if he had the powers, he would confer SAN on the two lead Counsels in the matter that day!

Coming from a Judge of the brilliance and character of Hon. Justice Bode Adegbehingbe, it was real high praise and one cannot but feel on top of the clouds.

We deeply appreciate His Lordship's comments.

EQUITY IN PRACTICE:
Aderemi, JCA (as he then was) in Ogbeide vs. Osifo (2007) 37 WRN 61 at 79-80: "Equity is a source of law, which has always retained the characteristics of infusing elements of fairness or justice into the legal system as a whole by the very process of mitigation of strict legal rules. It must however be realized that this characteristic, if care is not taken, is very often suppressed by technical legal reasoning or even worse still, nullified in preference for a rigid rule-based system of justice, This is a serious defect, which to my mind, always stems from two sources; narrow conception of property law and our much often adherence to legal positivism. That law in its raw form, is rigid, admits no argument. It is equitable principles that do water down this rigidity. It therefore seems to me that maxims of equity, if properly understood, constitute parameters for the legal determination between conscionable and unconscionable conduct"
