Move to Enforce 5% Recruitment Quota for Persons With Disabilities

The House of Representatives has reaffirmed its resolve to enforce full compliance with the mandatory 5% employment quota for Persons with Disabilities (PWDs) across all ministries, departments, and agencies (MDAs).

Deputy Speaker Benjamin Okezie Kalu made the commitment in Abuja on Wednesday at the Policy Forum on Advancing Workplace Inclusion for Persons with Disabilities, organised by the Shehu Musa Yar’Adua Foundation to mark the International Day of Persons with Disabilities. Describing the exclusion of PWDs as “not just a human rights violation, but economic sabotage,” Kalu stressed that Nigeria cannot build a resilient economy while sidelining millions of skilled citizens. He said the House is shifting “from advocacy to oversight,” empowering the Committee on Disability Matters to demand recruitment records and ensure MDAs comply with the 2018 Disability Act.

The Supreme Court has issued a directive preventing the Central Bank of Nigeria (CBN), the Accountant General of the Federation, and other relevant agencies from releasing funds to the Rivers State Government. This decision comes as a consequence of the government's failure to comply with prior court orders.

In a detailed judgment delivered by Justice Emmanuel Akomaye, the five-man panel of the Supreme Court unanimously dismissed the cross-appeal filed by Governor Siminalayi Fubara. The appeal challenged the legitimacy of the House of Assembly led by Martin Amaewhule as Speaker.

Justice Akomaye, in his one-hour, thirty-six-minute judgment, emphasized that Governor Fubara's attempt to present an appropriation bill before a reduced, four-member House of Assembly was an anomaly.

This action effectively deprived twenty-eight constituencies of proper representation and violated a court order mandating the governor to re-present the 2024 appropriation bill to a fully constituted Assembly chaired by Amaewhule.

The apex court further criticized Governor Fubara's actions regarding the alleged defection of twenty-eight Assembly members. The court described these actions as acts of brigandage and dictatorship, aimed at preventing the Assembly, under Amaewhule's leadership, from performing its legitimate duties.

Additionally, the court condemned the demolition of the Rivers State House of Assembly Complex by Governor Fubara. The demolition was seen as an act of indiscipline and an excessive use of executive power to hinder the Assembly's operations.

Finally, the Supreme Court's ruling mandated that Martin Amaewhule resumes his role as Speaker of the Rivers State House of Assembly immediately, alongside other elected members.

What you need to know

• Trump sentenced: President-elect Donald Trump has been sentenced to unconditional discharge for his conviction last year on 34 charges of business fraud related to hush money payment to Stormy Daniels during the 2016 presidential campaign.

• What this means: Unconditional discharge means Trump will not be imprisoned, fined or face probation, but his conviction still stands, and he will enter office as a convicted felon. Prosecutors had recommended the sentence, saying in court Friday, “we must be respectful of the office of the presidency” and Trump’s pending inauguration.

• How we got here: The president-elect successfully used the courts to delay the hearing, which was originally set for July, and urged the US Supreme Court to pause his sentencing in the case — a highly unusual request that relies in part on the court’s decision last year to grant him broad immunity from criminal prosecution. On Thursday, the high court rejected Trump’s emergency request to delay the sentencing.

Trump found liable in civil sexual abuse case
A Manhattan jury found Donald Trump liable for sexually abusing and defaming the former magazine writer E. Jean Carroll and awarded her $5 million in damages. More than a dozen women have accused the former president of sexual misconduct over the years, but this is the only allegation to be affirmed by a jury. Read the completed jury verdict form.

In the civil case, the federal jury of six men and three women unanimously found that Carroll, 79, had sufficiently proved that Trump sexually abused her nearly 30 years ago in a Manhattan department store dressing room. It also found that Trump had defamed her in comments about the case, but it did not find he had r***d her, as she had long claimed.

Trump’s lawyer said he intended to appeal. The former president’s lawyers called no witnesses, and he never appeared at the trial to hear Carroll, who had sued him last year, deliver testimony about the attack she said had ended her romantic life forever. The findings are civil, not criminal, meaning Trump has not been convicted of any crime and faces no prison time.

Statement: After the verdict, Carroll said: “I filed this lawsuit against Donald Trump to clear my name and to get my life back. Today, the world finally knows the truth. This victory is not just for me but for every woman who has suffered because she was not believed.”

Response: Many of Trump’s political rivals and opponents, including Gov. Ron DeSantis of Florida and former Gov. Nikki Haley of South Carolina, stayed quiet about the verdict. It is not clear how it will affect Trump’s presidential campaign.

Steps to recover your debt

Step 1
If the agreement to lend money is in writing, then follow the process laid out in the agreement for recovering the debt. As we mentioned above, a well drafted agreement should have a clause that explains what steps are to be taken to recover the debt, it would state how many days late you can be to make the payment, what happens if you are overdue, if there is a payment of any interest, etc.

It is therefore advisable to follow those steps if such a clause is in the agreement.

Step 2
If the agreement is not in writing (or doesn't lay out a debt recovery procedure), then you need to make what is known as a 'demand' by writing a 'Letter of Demand'. This letter of demand should state:
Who is involved - the name and address of both you and the person who owes you money
How much is owed
A date by which you demand payment (at least seven days)
Possibility of further legal action if payment isn't received (more on this below)

The letter should preferably be sent by a means that ensures delivery to the person, for example by using a courier where the letter has to be signed for.

Hopefully, a letter of demand shows that you are serious about recovering your money, but also and more importantly it lays the foundation for a potential court case (if this ultimately goes down that route)

Step 3

If after the period for payment as stated in the demand letter has expired, and the debtor has still refused to pay you, the next step would be to go to court.

We know what you are thinking - court ke?? I don't want to wait for 2 years before I see my money, I know that court cases in Nigeria can take years.

While that is generally true for most issues, you should know that the process for recovery of a debt, which is undisputed, is pretty straightforward, and the court processes in a number of other States allow for these sorts of cases to be fast-tracked.

For those who were wondering why we didn't send the newsletter out yesterday, well it's because we were waiting and hoping that one or both Presidential election petitions would be filed so we could do a brief analysis of it…and we were not disappointed.

Both of the leading opposition candidates have filed their petitions challenging the election of Asiwaju Bola Ahmed Tinubu (BAT) as the President of the Federal Republic of Nigeria, and in today's newsletter we will be doing a brief analysis of the petition filed by Mr Peter Obi (PO) – as this is the petition we have been able to get our hands on. Once we get our hands on the petition filed by Alhaji Atiku Abubakar, we will do an analysis on that as well.

You guys will recall that in our newsletter a couple of weeks ago we did a breakdown of the election petition process in Nigeria. So, if you didn't read it or need a refresher – check out our article on the election petition process in Nigeria


The Grounds of PO's Election petition challenge

Ground 1 – That BAT was ineligible to contest the election.
a. The first argument is that when BAT's vice presidential nominee - Kashim Shettima was nominated as the Vice Presidential candidate, he was still the Senatorial candidate for the Borno Central constituency. He only withdrew his candidacy a day after he was nominated. PO is arguing that since Shettima was nominated in Borno central constituency, and then nominated in the 'Nigeria' constituency (regarding the VP nomination), this is multiple nomination and therefore his nomination as VP is void , and therefore since his nomination was invalid, it taints the candidacy of BAT - and so he was therefore ineligible to contest the election.

They are dressed as characters from Margaret Atwood's dystopian novel, “The Handmaid's Tale,” and the eponymous TV series.

The women, growing in numbers as the demonstrations against Prime Minister Benjamin Netanyahu’s policies intensify, say they are protesting to ward off what they believe will be a dark future if the government follows through on its plan to overhaul the judiciary.

“This display is a representation of the things that we fear," said Moran Zer Katzenstein, founder of the women's rights advocacy group Bonot Alternativa, or “building an alternative,” which is behind the Handmaid's protest.

"Women are going to be the first to be harmed” under the overhaul, she added.

In a move that has sparked widespread opposition, Netanyahu's government is pushing to weaken the Supreme Court and limit the independence of the judiciary, steps they say will restore power to elected legislators and make the courts less interventionist. Critics say the move upends Israel’s system of checks and balances and pushes it toward autocracy.

The 2023 elections have led to so many people picking up an interest in understanding the legal process for how elections are conducted and how election petitions are resolved.

We love the fact that Nigerians are getting curious not only about the political process, but also about the legal framework that underpins the political process – and by extension, our democracy.

In last week's newsletter we had asked you to send in your questions about the election process, and the overwhelming question was around understanding how the election petition process is conducted in Nigeria.

So, in today's newsletter we will provide some more detail about how election petitions work under the 2022 Electoral Act.

Who can bring a challenge?

Theoretically any of the 18 candidates and their parties who contested in the 2023 Presidential election can bring a challenge. Section 133 of the Electoral Act 2022 states that an election petition may be presented by one or more of the following persons— (a) a candidate in an election; or (b) a political party which participated in the election.


What are the grounds for challenging an election?

The contestants and political parties can challenge the results alleging one of the following things:
a person whose election is questioned was, at the time of the election, not qualified to contest the election.
the election was invalid by reason of corrupt practices or noncompliance with the provisions of the Electoral Act
the respondent was not duly elected by majority of lawful votes cast at the election

Petitions against the decision of a presidential election are filed at the Court of Appeal – which is the designated election petition tribunal for Presidential elections.
