Recently, a lady came to me heartbroken. After years of living with her husband under customary rites, she discovered he had gone ahead to contract a statutory marriage with another woman. Notwithstanding the subsisting marriage, the law recognized that second marriage as valid.

In Nigeria, this happens more often than people realize. And it is because many people, particularly women, do not understand the difference between customary marriage and statutory marriage.

A customary marriage is conducted according to the traditions of the parties’ ethnic groups and often allows polygamy. A statutory marriage, on the other hand, is monogamous and governed by the Marriage Act. It means that once contracted statutorily, neither spouse can validly marry another person during its subsistence.

Understanding these differences can save you from heartbreak and legal battles. Marriage is more than an emotional commitment. In fact, marriage is a legal contract that establishes rights, duties, and protections. Understand marriage before committing to it.

Last month, a young tenant reached out to me in distress. Her landlord had suddenly doubled her rent, giving her just three weeks to pay or vacate. She felt helpless and stressed until she learned that the law was on her side.

Under Nigerian tenancy laws, a landlord cannot arbitrarily increase rent or eject a tenant without following due process. Rent increase must be reasonable, communicated properly, and in accordance with the tenancy agreement or state tenancy laws. It is no longer business but harassment when a landlord uses threats, disconnection of power, or intimidation to force a tenant out.

Many property buyers in Nigeria proudly hold their Certificate of Occupancy (C of O), believing it is the ultimate proof of ownership but here is a reality check in the light of extant laws.

Some years ago, someone came to me distraught. He had paid millions for land and received a C of O, only to discover later that the seller never had proper title to assign in the first place. Here is what you should know. A Deed of Assignment, properly drafted, executed, and registered, is what actually transfers ownership from one person to another. The C of O merely shows government recognition of possession, not the transaction itself.

Before you part with your money or celebrate “ownership,” ensure your documents tell the full story. Land ownership in Nigeria is not about who holds the biggest paper, but who holds the right instrument.
