Can your cargo arrive safely — and you still end up paying for someone else's loss?

The answer is yes.

Under the maritime doctrine of General Average, where cargo is sacrificed, or extraordinary expenses are incurred to save a ship and everyone on board, all parties who benefited from that sacrifice share the resulting loss or expense.

This longstanding principle is recognised under Section 177 of the Nigerian Insurance Industry Reform Act 2025, reinforcing the idea that in maritime law, when one person's sacrifice preserves the common adventure, everyone shares the burden.

Marine insurance is intended to provide financial protection against the risks inherent in maritime commerce. Yet, an insured party may lose the right to indemnity where there has been a breach of warranty under the insurance contract, even where the loss itself is unrelated to that breach.

In our book, Beyond the Horizon in Maritime and Arbitration Practice, Chapter Eight on Warranties Remain the Insurer’s Trump Card in Nigeria Marine Insurance: The Need for Effective Reform, examines the legal principles governing warranties in marine insurance and the significant consequences that follow from their breach. It considers whether the current Nigerian legal framework adequately addresses the balance between the interests of insurers and insured parties and argues for a more comprehensive reform of the laws regulating marine insurance warranties.

The discussion is particularly relevant to maritime practitioners, insurers, shipowners, and others engaged in maritime commerce, given the far-reaching implications of warranty clauses on insurance claims and risk allocation.
