NOTICES FOR THE RECOVERY OF POSSESSION OF PROPERTY

Note that after the service of the appropriate quit notice on the tenant as stated in series one, and if the tenant does not quit and deliver up possession, the landlord is required in law to serve on the tenant a "seven days notice of owner's intention to recover possession of property".

This "seven days notice' as popularly so referred is the last notice to be given before an action is filed in the appropriate court with jurisdiction by the landlord for the recovery of possession of property.

Take notice that where the tenant is a tenant at will (is already in arrears of rent), service on the tenant with the initial statutory notices is done away with as the tenant is no longer entitled to same being already in arrears of rent and still holding over.

A squatter is only entitled to a seven days notice and nothing more.

Series one.

For a tenant living in someone else's property referred to as the landlord, here are the required statutory notices to be given by the landlord to claim for possession of the property.

Yearly paying tenant 👉 half a year notice (6 months notice)

Half a year (6 months) paying tenant 👉 3 months notice .

A month paying tenant 👉 a month' s notice. Any notice shortt of the above notices renders the notice to quit invalid in law and can be challenged by the tenant.

However, the exception to the above statutory notices is if at the time of entering into the property, a tenancy agreement was signed which stipulates the duration of notice the tenant will be entitled to in the event of termination of the tenancy created.
