This is the day the Lord has made, I will rejoice and be glad. Happy glorious birthday to my humble self Adesanmi O. Afolabi Esq. In this new year, I pray that God Almighty grant me long life, sound health, sound mind, prosperity, good success, excellent spirit, divine uplifting, peace of mind, everlasting joy & happiness, journey mercies, unmerited favours, divine promotion, sufficient grace & mercy, and every goodies & benefits of the kingdom of God in Jesus name, AMEN 🙏

People keep asking: “Is intentional insult an offence under the Nigerian Law?” Based on the Federal Government’s charge filed against Sowore by the Attorney General of the Federation.

My answer is in the AFFIRMATIVE.

Reasons:

Intentional insult is a criminal offence under the penal code see S. 504 of the Penal Code but not an offence under Criminal Code Act or Criminal Code Law of southern states.

But charging him for intentional insult under “section 24(1)(b) of the Cybercrimes (Prohibition, Prevention) Act, on the basis that he “knowingly” sent “messages by means of press interview granted on Arise Television network which he knew to be false for the purpose of causing insult, enmity, hatred and ill-will on the person of the President of the Federal Republic of Nigeria”, is completely not out of order.

However, this raises a fundamental question “If Arise Television Network falls within the context of “Network” as defined in S. 58 of the Cyber Crimes Act. if the answer is in the affirmative based on my own understanding of the definition, then the A.G. FED. has done the right thing.

People beware, this is an eye opener that our right to freedom of speech as enshrined in S. 39 of the 1999 CFRN as amended has been curtailed to certain extent by S. 24(1)(b) of the Cyber Crimes Act in relation with S. 45(1)(a) of the 1999 CFRN.

Activists and Freedom fighters beware!!!
