Legal maxim is a general principle or proposition of law that's often stated in Latin. They're more general than ordinary rules of law and are used to formulate legal policies and ideals that judges consider when deciding cases.
Here are some examples of legal maxims:
Ab initio: Means "from the beginning" Actori incumbit onus probandi: Means "the burden of proof is on the plaintiff" Audi alteram partem: Means "no man shall be condemned unheard"
- Caveat emptor: A Latin phrase that means "let the buyer beware"
- Corpus delicti: Means "the facts and circumstances constituting a crime and concrete evidence of a crime"
- Damnum sine injuria: Means "damage without injury"
- De facto: Means "in fact"
- De jure: Means "by law"
- Dictum: A statement of law made by a judge during a decision but not necessary to the decision itself
- Doli incapax: Means "incapable of crime"
Legal maxims are usually not considered to be law, except to the extent that they're applied in adjudicated cases. They're general principles that can be deviated from in specific cases.
