No surprises here.
This has been established law for decades. The case law goes back almost 100 years. She tried to rely on common law marriage, a concept that does not exist under Nigerian Law.
Then she tried to establish that they were married under customary law. But a man married under the Marriage Act cannot lawfully conduct any other marriage, especially under customary law. That was the primary intent of the law.
I wrote extensively about this under my Marriage in Nigeria series.
I was dissapointed that she, a lawyer by training did know the position of the law. It is fundamental and foundational in matrimonial causes in Nigeria. As for her lawyers I am of the opinion they were down right negligent if not deceptive/fraudulent.
But to find out that she herself was lawfully married to Jimmy Lawal at the time of her purported customary marriage to Dr. Ajayi raises uncomfortable questions about Helen's intentions.
