The legal term of this week is DOMICILE. A terminology we often use or have come across a couple of times.

It refers to the permanent resident of a person. A person may have several residences, but only one domicile. In layman terms, a domicile is what we refer to as a person's 'permanent address'. In business, a domicile is the place or country in which a business is registered or has been incorporated.

Therefore, domicile is a legal construct used to determine where you vote, file lawsuits, pay taxes, claim benefits, and oblige governmental authority.

Although in Nigeria where it appears normal for the rights of people to be trampled on with no retribution but most times these things occur because a lot of people don’t know their rights and privileges or even seek them.

If you are someone who boards flights to various destinations within and outside the country quite often or once in a while; then Flight Delays or Cancellations won't be a strange experience. They can be a frustrating situation to deal with especially with local airlines. Traveling by air or using air transport services confers certain rights. But it also comes with some responsibilities. Among the main ones are:
1. The right to the full value for your money
2. The right to compensation for flight cancellation, delays, damaged/loss baggage and denied boarding for reasons other than technical, weather conditions, air traffic control restrictions, security risks and industrial disputes that affect the operation of the flight.
3. The right to book and confirm tickets with an airline of your choice.
4. The right to the provision of a conducive airport environment before, during, and after flights.
5. The right to seek redress for all irregularities during your flight.

A flight delay is when an airline flight takes off and/or lands later than its scheduled time.

Image Rights: What You Should Know...

Pretty sure you probably have heard the term Image Rights. Perhaps through celebrity gist or court cases relating to big-time stars or conglomerates over disputes related to Image rights infringement or charges by government filed against some star who evade tax from their Image rights earnings.

Absolute for sure, there's huge a whole lot of fortune in the industry centered around image rights. We are talking billions of fo dollars. But exactly are image rights and how does it apply to us from a legal standpoint in Nigeria.

Image Rights refer to a person's right to commercial aspects of his personality such as physical appearance, pictures or caricatures, signature, personal logos and slogan. This also includes the right to prevent other people from commercially making use of them.

It gives an individual the right to prevent the unauthorized use of their name, likeness or other personal indicia, such as physical or style characteristics, signatures, nicknames of slogans associated with them.

There apparently are no Nigerian Authority or Legislation that defines Image right or the extent of its protection. There are no specific laws governing Image Rights in Nigeria. There are also no known judicial precedence on claims of this nature.

However, the rights to privacy is enshrined in the Constitution as always has always been called in aid when claims of the nature arise. Section 37 of the Constitution of the Federal Republic of Nigeria provides for the privacy of citizens, their homes, correspondence, telephone conversation, and telegraphic communication.

It is however not clear how the courts will apply to the right to privacy in enforcing the image right of a person.

In Nigeria, the government understands that an unfavourable tax environment can inhibit the growth of any economy, so it has put certain incentives in place to encourage investments and business expansion. One of these incentives is the pioneer status incentive.

The pioneer status incentive is a tax holiday given to companies for a period of time, to encourage the growth and development of the Nigerian economy. A new company or an existing company with an expansion plan may apply for a certificate of pioneer status which lasts for 3 years and is renewable upon application for 2 years. It may also be a seven-year tax holiday in respect of industries located in economically disadvantaged local government areas of the country.

The Nigerian Investment Promotion Commission (NIPC) is the body in charge of administering this incentive.
