CAPACITY, CONSENT & EXPLOITATION:
WHY RIVERS STATE NULLIFIED ABOY’S MARRIAGE.

The reported nullification of the controversial marriage involving an autistic young man popularly known as “Aboy” by the Rivers State Government has triggered intense legal and ethical debate across Nigeria.

But beyond the emotional reactions online lies a more difficult legal question:
Did the young man possess the legal capacity required to validly contract a marriage?

Before the marriage, public posts by the facilitating pastor openly advertised financial incentives for any woman willing to marry him, including:
• accommodation,
• salary,
• medical care,
• overseas vacations,
• and housing benefits.

The arrangement immediately raised serious concerns surrounding:
• consent,
• vulnerability,
• exploitation,
• and mental capacity.

Under Nigerian law, marriage is not merely ceremonial.
It is a legal union that requires valid consent and the mental capacity to understand the nature and consequences of the relationship.

Importantly, autism itself does not automatically remove a person’s right to marry. Many autistic persons live independently, maintain relationships, and fully exercise their legal rights.

However, where there are legitimate concerns that an individual lacks sufficient understanding to independently consent to marriage, the law permits intervention to protect vulnerable persons from possible exploitation or abuse.

That appears to be the legal foundation upon which the Rivers State Government reportedly acted.

This controversy therefore goes beyond social media headlines.

It raises serious national conversations about:
• legal capacity,
• disability rights,
• informed consent,
• adult protection,
• and the limits of transactional arrangements in marriage.

The law must protect the dignity of persons living with disabilities.
But it must also ensure that vulnerability is not mistaken for consent.
