Sorry I have been away. I had to answer the call of nature to birth and nuture our new baby girl.

This is an inevitable phase and I'm so glad and thankful for the privilege.
I consider it a part of my professional development and career growth. Lool! You heard right.

Trust me when I say I have missed you all.

You may have followed the recent thread about a Nigerian celebrity whose property (house) was taken over by Asset Management Corporation of Nigeria (AMCON) on the basis that it was used as a collateral for a loan which her sponsor (who gifted the property to her)defaulted in repaying.

Assuming without conceding that the publication was true, I can imagine the number of lawyers that laughed on hearing the news and I'm guessing they would say ''Una no dey hear word na''

Imagine a scenario where you were gifted a car, a house or any property at all, you moved in and have infact been enjoying it for years only for someone to show up with a court judgement and tell you that they intend to sell it to recover a debt owed by the person who gifted the property to you.

That person armed with the judgement would be right in the circumstance because there is no document from you to show that indeed ownership of the property has been transferred to you.

The Conveyancing Act/laws makes provision for conditions to be met before a Title in land for instance can be successfully transferred to another. One of which is that it must be by DEED ie it must be Signed, Sealed and Delivered.
A simple agreement should however suffice for properties other than landed properties or receipts bearing your name as the owner.

So before you get over excited about a gifted property, be sure to document the transfer of ownership end to end to avoid stories that touch the heart.

Recovery of Debt literally means THE PROCESS of getting back what is yours. Usually what accrues to you after an agreement where parties have spelt out their rights and obligations and have committed to playing their parts.

Debts could be in cash or kind.

You can hardly come across a business Owner/Investor who isn't owed a debt or who is not owing someone.

Overtime, I discovered that cases of Recovery of Debts that eventually make it to court end up being thrown out for lack of substantial evidence.

Its easier to recover your debt when you document your transactions, even the procedure to recover such in court is faster when compared to a situation where the terms are vague.

How do you handle Recovery of Debt as a business Owner/Investor?

So many reactions have met the new Guidelines on Global Standing Instruction 2020 recently published by CBN.

In any case, it affects Individuals, Business Owners/Investors,Banks, Financial Institutions etc.

So my friend Obi rents a space for his
business but due to his tight schedule decides to have his friend Richard (who always came to him for support) manage the space while he concludes plans to get work fully started there.

The first year elapsed without him really using the space because his plans didn't materialise as they ought to.

Meanwhile, Richard decided to consolidate his personal business and infact started doing well, getting grants and sponsors left right and center. He branded the space to represent his Organisation and let's say everyone knows he stays there.

Obi renewed the rent with part payment and decided to inform Richard that he would like to resume fully as things have started falling into place.

My people, that was how Richard turned around to say that Obi was an Enemy of progress who didn't like the way he was progressing. Hahaha, it got me laughing really. He asked him to name his price that he wants to pay him off and maintain the space since he has established his presence there.

The space in question is in a choice location and the price doesn't represent the value which is why Obi can't even fathom relinquishing the space.

Richard's lawyer was already saying "In law, whoever is in possession has a superior title for the time being".
I laughed again because Richard and Obinna know exactly what their agreement was but how can a third party tell? "Na the matter we still dey settle"

This goes a long way to drive home the fact that the need for Legal documentation cannot be over emphasized.
It saves time,energy and resources.
A simple Agreement at the initial stage would have solved the problem above.

So many things trouble our soul

The most recent being gruesome Murder of Blacks just because they have a different shade of Beauty, Uniqueness and Resilience.

The picture has never been clearer of how a human can,without flinching, end the life of another in broad daylight, not in the guise of Robbery, Banditry or Terrorism but being empowered by a System that encourages such degree of brutality without just cause.

Our hearts are troubled

The incessant r**e of underage boys and girls especially. I still can't fathom it.

During my Internship, I remember our Firm handling a case of r**e of a 4 year old by her Proprietor.
Her Mum couldn't stand the thought of it,she wept so badly while throwing herself all over the place.

This little girl was just 4! for every time I tried to look at the girl, my heart bled.
What on earth was this man thinking?

He bought her biscuits and helped her with her homework while she waited for Mummy/Daddy to come pick her up from school. Ohhh!!!! This was according to the girl's Mum (based on the Child's narrative)

This act could cause the victim to bleed to death where an intervention isn't timely which the situation we are currently faced with.
In the case of this 4 year old, she managed to survive but she couldn't urinate with the speed she ought to within that period. I still can't get the thoughts off my mind.

We must keep talking over these issues until the justice of each case is met.

It is hard enough that we are trying to recover from a ravaging pandemic, the security threats, Loss of jobs and Businesses, Racism and now another level of R**e trending.

On the issue of R**e, we need to pay closer attention to the people our children associate with as some of the cases recorded involve persons that are close to the family of the victims,people they are familiar with that won't ordinarily raise any suspicion.

Also girls are not the only victims of r**e, infact there may be more cases of boys being r**ed so there's need to be attentive both ways.

In all, may divine healing envelop our hearts and may we record progress going forward.
We shall overcome

There's no doubt that this Lockdown birthed lots of ideas in you.
My guess is that it has helped you rethink certain decisions and the odds are that you have decided to restrategise in many areas especially as it pertains to your business.
In a bid to cushion the effect of the lockdown, the Government has released some funds to favour certain sectors of the economy eg Health, Agribusiness, Manufacturing industries and a few others.

Now we don't know their next focus but you must never be caught "Unfresh" I mean Unprepared in this context. Lol

It is not enough to have great ideas so you must take it a notch higher by taking the necessary steps to register those ideas with the relevant regulatory agencies thereby putting a face to it. That way, when Government,Investors or Big clients seek to support/patronize businesses like yours, you would have been strategically positioned to access the grants or loans.
Business Registration is necessary for:

1. Individual(s) living in Nigeria and intend to carry out their business in Nigeria.

2. Individual(s) who don't live in Nigeria but intend to carry out their business in Nigeria.

3. Foreigners who live within or outside Nigeria and intend to carry out their business either by way of starting a new business or expansion of an existing business.
