The law provides that “any person who accuses or threatens to accuse any person with being a witch or with having power of witchcraft is guilty of a misdeamenour, and liable to imprisonment for two years”

You cannot just go about calling people a witch. It is a criminal offence to so do.

The law provides that “any person who having reasonable notice that he is required to assist any peace officer or member of the police force in arresting any person or in preserving the peace, without reasonable excuse omits to do so, is guilty of a misdemeanor, and is liable to imprisonment for one year”

The provision presupposes that the police is your friend and you owe a duty to help your friend in the performance of his duty of security of life and property.

The law provides that “any person who being a person employed in the public service and being required by any order, Act, Law or Statute, to do any act by virtue of his employment, perversely and without lawful excuse omits or refuses to do any such act is guilty of a misdeameanour, and is liable to imprisonment for two years”

This law applies to public officers who refuse to do their duty unless they have received some form of gratification.

The law provides that “any person who, on any occasion on which a person making a statement touching any matter is required by law to make it on oath, or under some sanction which may by law be submitted for an oath, required to verify it by solemn declaration or affirmation, makes a statement touching such matter which in any material particulars is to his knowledge false and verifies it on oath, or under such other sanction or by solemn declaration or affirmation, is guilty of a felony, and is liable to imprisonment for seven years”

Affidavits obtained from court have become an avenue for individuals to make all manner of false statements without knowing that such act is a criminal offence punishable with 7 years imprisonment.

The law provides that “any person who for the purpose of procuring a passport, whether for himself or any other individual, makes or causes to be made in any written application to a public officer a statement which to the knowledge of such person is false in any material particular is guilty of an offence, and is liable to imprisonment for one year"

This applies to persons who make false statements to immigration officers when processing their passport application. An example is where a person lies as to his date of birthday and other information.

𝐈𝐭 𝐢𝐬 𝐚 𝐜𝐫𝐢𝐦𝐞 𝐭𝐨 𝐝𝐞𝐥𝐚𝐲 𝐭𝐚𝐤𝐢𝐧𝐠 𝐚𝐧 𝐚𝐫𝐫𝐞𝐬𝐭𝐞𝐝 𝐩𝐞𝐫𝐬𝐨𝐧 𝐭𝐨 𝐜𝐨𝐮𝐫𝐭

The section provides that “any person who, having arrested another upon a charge of an offence willfully delays to take him before a court to be dealt with according to law is guilty of a misdemeanor, and liable to imprisonment for two years”

A law enforcement agent who arrests a person but detains such person for more than 24 hours can be prosecuted under this section. The maximum duration of detention without taking a detained person to court is 48 hours. This however, does not apply when a person is arrested on the allegation of commission of a capital offence.

The law provides that “any individual who gives any information which he knows or believes to be false, to any person employed in the public service with the intention of causing such person (a) to do or omit to do anything which such person ought not to do or ought not to omit to do if the true facts concerning the information given were known to such person; or (b) to exercise or use his lawful powers as person employed in the public service to the injury or annoyance of any other person, is guilty of an offence and liable to imprisonment for one year”

The offence consists in knowingly and intentionally giving false information to a public officer (especially law enforcement agents) thereby inducing them to make an arrest or even detain another person. This is common when a person tries to convert a purely civil action into a criminal one. An example of this crime is when a person who entered into a contractual agreement with another person reports to the police a case of fraud because the other person failed to honour the agreement. Any person responsible for such act is guilty of a criminal offence: lying to a public officer.

The law provides that “any person who being employed in the public service takes or accepts from any person, for the performance of his duty as such officer, such reward beyond his proper pay and emoluments, or any promise of any reward, is guilty of a felony, and is liable to imprisonment for three years”

The practice of receiving money for bail by law enforcement agents is a criminal offence punishable under the law. Law enforcement agents are public officers who are not allowed to take or accept any money for the performance of their public duty. It is the duty of law enforcement agents to grant a person bail when they cannot charge the person to court.

The Criminal Code Law provides that “any person who takes part in a fight in a public place is guilty of a misdemeanour and liable to imprisonment for one year”

The law seeks to maintain law and order in the society. Members of the society are encouraged to desist from any action that may lead to the breakdown of law and order. This includes avoid fighting in the public.

It’s believed that one of the reasons people commit crime is because they do not know that the particular act or omission is a crime. However, ignorance of the fact that a particular act or commission is a crime is not a defence to engaging in the same act or omission.

The Criminal Code Law provides that “ignorance of the law does not afford any excuse for any act or omission which would otherwise constitute an offence, unless knowledge of the law by the offender is expressly declared to be an element of the offence”

This simply means that the fact that a person is not aware that a particular act or omission is a crime will not save the person if he is caught doing the act or omission. The practical issue is that all the laws are made on the presumption that every person knows the law. This is good principle because if ignorance was an excuse, every person caught committing a crime will claim they do not know that the act or omission is a crime. We will discuss some acts and omissions which many do not know is a crime but is actually a crime.

𝗗𝗔𝗡𝗚𝗘𝗥𝗦 𝗢𝗙 𝗕𝗨𝗬𝗜𝗡𝗚 𝗔 𝗣𝗥𝗢𝗣𝗘𝗥𝗧𝗬 𝗪𝗜𝗧𝗛𝗢𝗨𝗧 𝗩𝗘𝗥𝗜𝗙𝗬𝗜𝗡𝗚 𝗧𝗛𝗘 𝗢𝗪𝗡𝗘𝗥𝗦𝗛𝗜𝗣 𝗢𝗙 𝗧𝗛𝗘 𝗦𝗘𝗟𝗟𝗘𝗥

The consequence of buying goods from a person who is not the owner or does not have the authority of the owner to sell is better imagined/read about than experienced. The best case scenario is that the buyer loses both the property and money. The worst-case scenario is that the buyer is arrested, detained and possibly prosecuted where it is stolen property.

A is in possession of a motor vehicle based on a hire purchase agreement with the original owner. A knows the motor vehicle belongs to another person but decides to sell it. A offers to sell the motor vehicle to B. B, if he is a prudent buyer, will ask for proof of ownership of the motor vehicle. If A shows the proof, B buys. If not, B does not buy. This will save B from any claim from any third party. And also protect B from fraudulent individuals.

On the other hand, Y steals a motor vehicle and decides to sell it. Z buys the motor vehicle without verifying the title of Y. The police have traced the vehicle to Z. As a result, Z has been arrested for having a stolen vehicle. It becomes more complicated for Z when investigations revealed that the vehicle was stolen in the course of an armed robbery. The whereabouts of Y remain unknown. Z is staring at a criminal prosecution for an offence he knows nothing about. Z could have avoided this trouble if he cared to ask for proof of ownership of the vehicle.
