丹麦男团 的上诉庭案
上诉庭裁决出炉 我方胜诉。
这个案子很特别,因为它牵涉到90年代风靡全球的丹麦男团 Michael Learns To Rock (MLTR) 的演唱会。
我们代表的是乐团的经记公司。2019年,经记公司与一名演唱会主办方达成协议,计划在东南亚多个城市举办巡回演唱会,其中一站定在马来西亚吉隆坡,原定于2020年2月举行。
然而,该主办方并未如期展开实质筹备工作,却多次要求展延甚至转让主办权。直到2020年2月,对方试图以“新冠疫情”为由,援引 force majeure(不可抗力)条款,要求延期演出。
但事实是:
• 当时(2020年2月),政府及世卫组织尚未宣布任何行动管制措施;
• 同期吉隆坡仍有多场大型演唱会顺利举行;
• 主办方并未进行任何实质准备工作;
• 对方甚至提出担心售票不佳、可能亏损等理由。
这些,都不能构成法律上的“不可抗力”。
对于早已安排好档期、行程紧凑的国际艺人来说,临时展延不仅影响巨大,也极不公平。因此乐团方面不同意延期。
结果,对方不仅要求退回已支付的美金演出费,更将乐团经纪公司告上法庭。
两年前,我们成功在高庭为客户抗辩胜诉。对方随后提起上诉。
昨天,上诉庭维持高庭裁决 ,我方再次胜诉,并获判RM20,000 堂费。这已是第二次上诉,案件至此尘埃落定。
更令人欣慰的是,MLTR 并没有因为这场风波而放弃马来西亚的粉丝。2022、2024、2025年,他们都再次回到马来西亚开唱,并获得热烈回响。
有些音乐会落幕,但有些经典,真的会继续 rock 下去。

Michael Learns To Rock and they continue to rock.
The Court of Appeal has delivered its decision in our client’s favour.
This was a particularly interesting case as it involved the 90s Danish pop-rock band Michael Learns To Rock (MLTR) and their concert tour.
We acted for the band’s agency. In 2019, the management company entered into an agreement with a concert organiser to stage a Southeast Asia tour, with one of the shows scheduled to take place in Kuala Lumpur in February 2020.
However, the organiser failed to carry out the necessary preparations. Instead, they repeatedly sought postponements and even attempted to transfer the organising rights. Eventually, in February 2020, the organiser attempted to invoke the force majeure clause, citing COVID-19 as the reason to postpone the concert.
The facts told a different story:
As of February 2020, neither the Malaysian Government nor the World Health Organization had imposed any movement control orders.
Several large-scale concerts were still being held in Kuala Lumpur during the same period.
The organiser had not undertaken any substantial preparatory work.
They even cited concerns about poor ticket sales and potential financial losses.
Commercial concerns and internal lack of preparation do not amount to force majeure.
For an international act with tightly scheduled tour dates, a last-minute postponement would have caused significant disruption and was plainly unfair. The band therefore did not agree to the postponement.
The organiser subsequently demanded a refund of the performance fee (paid in USD) and commenced legal proceedings against the management company.
Two years ago, we successfully defended the matter in the High Court. The organiser appealed.
Yesterday, the Court of Appeal affirmed the High Court’s decision — we prevailed again. Costs of RM20,000 were awarded in our client’s favour. As this was the second appeal, the matter has now reached its final conclusion.
Most importantly, MLTR did not give up on their Malaysian fans. They returned to Malaysia in 2022, 2024 and 2025, each time to an enthusiastic reception.
Some concerts may be postponed.
But some classics will always continue to rock.
