LEGALISATION OF STATEMENT OF MARITAL STATUS IN MALAYSIA BY NOTARY PUBLIC. (Certificate/letter of Single Status issued by JPN)

Statement of Marital Status issued by Malaysia’s National Registration Department (JPN) is required if you are a Malaysian planning to register a marriage in China. To be recognized by Chinese authorities, the document must be translated, notarized, and legally authenticated.

Step-by-Step Application & Legalization ProcessTo get your:-

* Obtain the Certificate at JPN In Person: Visit your local JPN branch with your IC, passport, and a completed JPN.KC09 Form.

* Statutory Declaration: You will need to make a statutory declaration (Surat Akuan Sumpah) declaring your single/unmarried status in front of a Commissioner of Oaths.

*Validity: The JPN Single Status Certificate is only valid for 150 days, while Chinese authorities generally require it to be issued wthin 6 months.

2. Translation and Notarization Have the JPN certificate translated into Chinese by a certified translator or an authorized court translator. Take the original and the translated document to a Notary Public in Malaysia for notarization.

3. Ministry of Foreign Affairs (Wisma Putra) Authentication Submit the notarized documents to the Malaysian Ministry of Foreign Affairs (MFA) to verify the documents.

4. Consular Legalization at the Chinese Embassy Submit the MFA-authenticated documents to the Chinese Embassy in Malaysia or the Chinese Visa Application Service Center.

NOTARY PUBLIC or COMMISSIONER FOR OATHS?

Many people are confused about who can certify documents intended for use overseas — a Commissioner for Oaths or a Public Notary?

Many people come to my office because the documents they intended to use abroad were rejected by the Ministry of Foreign Affairs in Putrajaya as the documents had been certified by a Commissioner for Oaths instead of a Public Notary. They were then instructed to have the documents certified by a Public Notary instead. WHY?

COMMISSIONER FOR OATHS: Documents that are sworn or affirmed can only be used within Malaysia.

PUBLIC NOTARY: Documents that are notarised can be used both overseas and within Malaysia.

NOTARY PUBLIC AND LEGALISATION IN MALAYSIA (SIMPLE GUIDE)

What is Document Legalisation?
Document legalisation is a process that makes your Malaysian documents officially accepted in another country.Because Malaysia is not part of the Apostille system, you must go through 3 steps:
1. Notarisation
2. Ministry of Foreign Affairs (Wisma Putra) verification
3. Embassy authentication

This creates a chain of trust so foreign authorities know your document is genuine.

DOCUMENTS COMMONLY REQUIRED FOR LEGALISATION, inter-alia:-

• Power Of Attorney, Affidavit, Statutory Declaration, Authorization Letter.

STEP-BY-STEP PROCESS

STEP 1: NOTARISATION (NOTARY PUBLIC)

A Notary Public (lawyer) will attest your documents as instructed which include: -
1. To Certify True Copy of the Original
2. To authenticate the authenticity of the Documents
3. To attest the signing of documents esp for documents which require it to be signed before an attesting officer (Notary Public).
4. And any other instructions which relate to the Notarial acts.

STEP 2: WISMA PUTRA (MOFA) ATTESTATION

This is the Malaysian government verification step.

What they do:
Confirm the notary’s signature OR
Confirm the original government document.

What to bring:
Original document
IC or passport
Cost: RM10 or RM20 per document (depending on type of documents)
Processing time: Usually same day

STEP 3: EMBASSY AUTHENTICATION

Final step: the destination country’s embassy verifies your document.

Go to the embassy of the country you’re dealing with
Book appointment (if required)
Submit document with Wisma Putra stamp.

Identification card OR SSM (Company’s Registration Search) if any,
Application form (if needed)
Payment
Cost: Varies widely (RM20 to a few hundred) (depending on the fees charged by the Respective Embassy.
