This happened just after CNY holidays.

This is the first time in my years of practice (hopefully not the last) that spouses are able to reconcile despite divorce petition and cross-petition being filed. Having parties including solicitors who are mature and reasonable is a great assistance to the court. With that, I would like to thank Ms Manjula Prakhakaran for being a cooperative and commendable opponent. Great camaraderie shown throughout the matter.

I wish the couple all the best in marriage.

BOVAEP has issued several notifications on 1 Mar 2024, which are self-explanatory.

The notifications are as follows:
(1) Preparation of Tenancy Agreement (Notification 3/2024);
(2) Prohibition against Demanding or Obtaining Referral Fees from Solicitors (Notification 4/2024);
(3) The Rights of Legal Representatives of Client's Choice (Notification 5/2024).

The notifications are available on BOVAEP's website at lppeh.gov.my. Attached herewith the said notices for easy reference.

Following the Budget 2024 announcement, the prevailing Sales and Service Tax (SST) rate will increase from 6% to 8%, effective from 1 March 2024, on selected taxable services.

To ensure a smooth transition, our Firm will adopt the following approach:

1. SST of 6% applies to taxable services provided before 1 March 2024.

2. SST of 8% applies to taxable services provided on or after 1 March 2024.

3. For services extending over the effective date, the SST will be apportioned based on the service duration:

(a) Portion before the effective date – 6%
(b) Portion on or after the effective date – 8%

Please note that the information provided is based on the draft guide dated 7 February 2024 and published Panduan Peralihan Perubahan Kadar Cukai Perkhidmatan dated 26 February 2024 issued by the Royal Malaysian Customs Department. The above positions may change once legislation or further guidance from the Government of Malaysia is released.

Inter-floor Leakage, Upper Floor Unit Owners always to be Blamed?
Can the statutory presumption under Section 142 of the Strata Management Act, 2013 be used as an excuse for the Joint Management Body or the Management Corporation (whatever the case maybe) not to carry out the inspection as mandated under Regulation 57 of the Strata Management (Maintenance and Management) Regulations 2015 before arbitrarily ‘determining’ that the upper floor unit to be the source of leakage?
The client, the upper floor unit owner, came to us with a Strata Tribunal Award against them. It turned out that the Management had issued a certificate or more commonly known as the Form 28, determining that our client’s unit was apparently the cause of leakage and the party responsible to rectify the same. Now what is curious is that the Form 28 was issued without inspection of our client’s unit. The only inspection that was carried out was at the affected unit. Subsequent correspondence exchanged also revealed that there was uncertainty as to the actual cause/source of leakage. Nevertheless, the Management simply shrugged its shoulder and purported to seek cover from the statutory presumption.
Naturally, client was unsatisfied with the Tribunal Award and we were instructed to file for judicial review. We took the position, inter alia, that the statutory presumption does not mean inspection of the upper floor unit is exempted. The Management has no power to omit carrying out inspection by taking advantage of the statutory presumption. If at all, such presumption is but one of the matters to be taken into consideration when determining the cause/source of leakage.
We were pleased to inform the client that the High Court is with us and quashed the Tribunal Award.
So yes, just because there is a statutory presumption, it does not mean that the Management can issue a Form 28 without the necessary inspection including the upper floor unit as mandated.
