The Federal Court decision of Ang Ming Lee & Ors v Menteri Kesejahteraan Bandar, Perumahan dan Kerajaan Tempatan & Anor is a landmark decision which nullify Housing Controller's extension of time to deliver house keys.

I shared that there seems to be an ongoing attempt at circumventing the Federal Court decision to allow the authorities to again extend the deadline for delivery of house keys.

【员工贪污，公司和董事一起受罚】

反贪委员会的公司责任条款已经正式生效。如果公司员工贿赂，公司和公司领导层也可能被一起控告。无论如何，公司可以在内部实行‘充足措施’以便减少风险并在万一被控告时提出法律辩护。

The corporate liability provision in the MACC Act has came into force. Under the provision, a company and/or its directors may be personally liable for offence committed by its staff and agents. The saving grace is that companies may implement 'adequate measures' within the company to minimize risk and raise as defence in the event of prosecution.

An offshore vessel support company has become the first company in Malaysia to be charged with a newly introduced provision which imposes corporate liability under the Malaysian Anti-Corruption Commission (MACC) Act 2009.

The Federal Court today delivered a landmark decision and ruled that for purpose of calculating late delivery compensation, the date of payment of booking fee shall be used as the starting point as opposed to the date of sale and purchase agreement.

首相慕尤丁在劳动节的全国致辞里宣布大多数商家可以在5月4日复工。同时，首相也宣布餐厅和咖啡店可以在遵守一些条件的情况下接受堂食。这对已经熬过40多天行管令的大家来说，肯定是很期待的。

同时，为了方便追踪病患，政府要求餐厅业主记录堂食顾客的姓名，电话号码和光顾时间和日期。这个措施立刻挑起广大食客的敏感神经线。相信很多人时不时都会收到来电索取银行户口资料甚至是咋骗集团的来电。在这个情况下，大家都会怀疑他们的个人资料是否已经被滥用。

当然，有人说如果不想透露个人资料，那大可以打包食物回家享用。

这个说法是没有错，但从餐厅业主的角度出发，他们会希望客户可以放心的在他们的餐厅或咖啡店享用食物，籍此提高生意额。

客户有时也因为某些原因必须在外面用餐。

这篇短文会简单介绍马来西亚个人资料法律并且提供一些建议。

问1️⃣：个人资料也有法律保护吗？

答1️⃣：个人资料保护的处理和使用在很多年以前已经在外国受到特别法律保护并相当普遍。马来西亚的【2010年个人资料保护法令】在2013年正式生效。

问2️⃣:废话少说。我是餐厅业主，我肯定不会滥用客户的个人资料，那我可以做什么来给我的客户信心？

答2️⃣：顾客的姓名和电话号码被归类为个人资料并受到法律的保护。餐厅业主作为收集个人资料的一方可以准备一份【个人资料通知书】并陈列在客户资料书的旁边。这是法律要求并可以直接给客户信心这个餐厅绝对尊重个人资料的应用。【个人资料通知书】需要包含以下内容：
a) 客户的个人资料会被餐厅收集注明将会被收集的个人资料
b) 个人资料的收集用途
c) 个人资料的来源
d) 注明客户检阅并且要求修改本身个人资料的权利
e) 联络餐厅提出关于个人资料的请求或投诉的方式
f) 餐厅是否会对第三方披露客户个人资料并且他们的基本资料
g) 提供个人资料是否是志愿性的
h) 客户可以限制餐厅处理自身个人资料的方法和选择

问3️⃣：【个人资料通知书】需要以什么语言书写？

答3️⃣：【个人资料通知书】至少要以国文和英文书写。如有需要，可以额外准备华文版本。

问4️⃣：除了【个人资料通知书】，餐厅业主还有什么要注意的吗？

答4️⃣ :作为收集个人资料的一方，餐厅业主需要遵守一系列的责任，其中包括不要随便泄露客户的个人资料，进行相关措施确保客户的个人资料被保护妥当，在客户的资料不再被需要时销毁资料，确保客户的资料是正确等等。

问5️⃣：我是客户，我有什么权利吗？

答5️⃣：客户有权利要求餐厅让自己检查已被收集的自身个人资料并且在个人资料出现错误的情况下要求修改。客户也可以要求所提供的个人资料不可以被作为其他用途例如销售用途。
