WHAT YOU NEED TO KNOW ABOUT YOUR TENANCY DURING THE PERIOD OF MOVEMENT CONTROL ORDER (“MCO”)

Q1 – What happens to my Tenancy?
A1- STILL VALID, so long you have entered into a Tenancy regardless in “Black & White” or “Pakai Mulut saje”, you are bound to the terms of the Tenancy. Tak Boleh Lari!!!
BUT !!! Please check whether is there a clause called Force Majeure in your Tenancy Agreement if you cuba mau lari from the Tenancy (Not applicable on Pakai Mulut punya Tenancy).

Q2 – What is Force Majeure?
A2- Force Majeure clause usually gives chance to the parties of the contract to terminate or to suspend their obligation if there is an unexpected and unforeseen events occur which beyond a party’s control such as declaration of wards and/or acts of God.

Q3 – What if there is a Force Majeure clause?
A3- Congratulation, your tenancy agreement not badly drafted. you got chance to escape but still depends on how your agreement is drafted. Please look at the consequences in Force Majeure clause of your Tenancy Agreement.

Q4 – What if there is NO Force Majeure clause?
A4- Don’t give up, please continue reading on the following Q&A.

Q5- Can the tenant ask for adjustment on rental?
A5(a)- Yes, if you are the Tenant, you can try your luck by asking your Landlord Tai Kor or Tai Kar Je whether he or she can WAIVE (God Level) or DISCOUNT (Semi God Level) or DEFER (Quarter God Level) your payment on rental. If you can’t get (Oh My God Level), Please try again until confirm no chance given.
If you got blessing from your God (Landlord), remember put the agreed terms in BLACK and WHITE (ini saya ade sampel, please whatsapp me).
A5(b)-If you are the Landlord, you can diam-diam buat tak tahu if the Tenant didn’t ask you any from the above.

Q6- How about the Rental, do the Tenant still need to pay?
A6- Generally the Tenant still has to pay the rental during the period of MCO. UNLESS
(i) there is a Force Majeure clause as explained above in your Tenancy Agreement; or (ii) Miracle as mentioned in A5(a) above is happened.

Q7 – What happens if the Tenant refuses or omits or fails to pay rental?
A7- STANDARD - SUE THEM!!! Please look at the clauses of your Tenancy especially those clauses deal with “Default or Termination”. Usually it requires you to serve a notice of demand or termination to the Tenant in the manners as stated in in the Tenancy Agreement.

Q8- What happens if the Landlord terminates the Tenancy Agreement?
A8- The Tenant is required to vacate/redeliver the property upon expiry of the notice as mentioned in
A7 otherwise the landlord can also sue the Tenant for any outstanding rent.

Q9- What happens if the tenant refuses to vacate/redeliver the property?
A9(a)- Landlord can sue the Tenant for “Double Rental” from the date which the Tenant is supposed to vacate or redeliver the Property to the Landlord until the Property is vacated or redelivered; and/or
A9(b)- Landlord also may file a legal action against the Tenant to obtain an Order for eviction but this legal action not cheap and may take few months.

Q10- Can the Landlord changes the locks, or cut the water or electricity supply or enters into the property without the court order?
A10- NO!!! all the above acts are illegal in the eyes of law although your Tenancy Agreement may mentioned "you got the power to do so".
Conclusion:- Everything is depends on either the terms of the Tenancy or the level of relationship between the Landlord and the Tenant.
